I'd love to see a test case for this. I can't imagine the CPS would be crazy enough to try and prosecute someone for looking at their wrist, whether it's a smartwatch or not.

It is bonkers. I can legally operate my ham radio while driving as it doesn't come under the restrictions for mobile phones. However, if I were to be involved in some incident while doing so, I'm sure that driving without care and attention or dangerous driving would come into play.I've always found this an interesting one comparing fiddling with a phone in a car vs fiddling with the factory radio/stereo/air con controls/windscreen wipers/cruise control....... etc. Can you fiddle with any of that as long as you want since it is fixed/mounted/built into the dash? What about a mounted phone on a holder? What about touch screen head units now?
I’m going to guess someone was busted for using a smartwatch while driving and then tried to fob the police officer off by saying they were only checking the time.The police would prosecute rather than CPS, but realistically glancing at your watch - smart or not - isn't going to get you prosecuted. Interacting with it for a prolonged period of time which constitutes it being a distraction would, but that's the same for anything really.
The law was updated to wording akin to internet connected device.
