Armstrong fails to block £79m US government lawsuit

It's interesting that this has evolved from the case Landis originally brought. Why isn't he being sued as well? Whistleblowers privilege I suppose.

CyclingWeekly said:
The premise of the case is that Armstrong and the Tailwind Sports management company that owned the US Postal team, defrauded the government out of funds as Armstrong and other members of the team used performance-enhancing drugs.

Armstrong attempted to have the ‘whistleblower’ case thrown out, arguing that the benefit to the US Postal Service in terms of exposure outweighed the money it gave the team through sponsorship.

However, Judge Christopher Cooper of the US District Court for the District of Columbia denied Armstrong’s motion on Monday, February 13, saying:

“Because the government has offered evidence that Armstrong withheld information about the team’s doping and use of PEDs and that the anti-doping provisions of the sponsorship agreements were material to USPS’s decision to continue the sponsorship and make payments under the agreements, the Court must deny Armstrong’s motion for summary judgment on this issue.”

Landis stands to obtain 25 per cent of any money recovered from Tailwind Sports and Armstrong. The total is estimated to be three times the $32.3 million sponsorship money US Postal paid to the team.

Armstrong has previously said that he does not have $100m, and would stand to lose all of his remaining fortune.

More meaty article. Most of the juicy bits above.

And the one man witch hunt goes on and on and on and on

I don't like the man but you'd think he was the only man in the sport doing drugs and to see other cheats avoiding punishment and in this case looking like scoring loads of cash is pretty sickening.

The only thing cheats like Landis should 'gain' is a lack of prosecution from coming forward. There should be no cash 'incentives', the only way I can see a cash incentive working is if there's no direct cheating by the person involved. The medical staff were only taking orders from the doctors/Team directors, they should be the ones given cash incentives to come forward with evidence. I feel that any of the riders 'escaping prosecution' should be stripped of any/all titles, their racing licences revoked but legal agreements signed that they have supplied all evidence they are aware of pertinent with any doping during that period. Failure to disclose anything important should void their lack of prosecution and they are held to account.

Lance is being used as a scapegoat, but I think he should be the one with the brunt of the blame due to his actions and steps of avoidance he took.

Hiding behind a medical profession doesn't serve as sufficient defense. Integrity & Professional Conduct are ethical principles in many frameworks of official professional bodies. Merely 'doing as you're told' isn't grounds not to be held accountable.
