Hiya folks,

Sold my old car in June and cancelled my insurance policy with Aviva on the 30th June.

At the time they said that no money was due and that I would also be given a refund of £48.35 which I promptly recieved on the 3rd of July. All was well and I thought nothing more of it.

Fast forward a month to this morning and I get a letter from them stating I owe them £63.66 to which I am quiet shocked. So I get on the phone straight away and ask them how on earth they think I owe them money when it was clearly stated at the time of cancelled that I didn't owe anything, I even have it in writing.

They said a payment was due on the 1st July to cover the perioud of 1-30 June, which in itself seems daft, since when has insurance been paid in arrears, I checked the policy booklet and there's no mention of this at all.

What really irritates me though is the letter received stats final notice etc, its the only notice i've had from them and if the insurance premium had been declined by my bank I would had notice from them also. Sounds like they are trying to pull a fast one to me!

If you have it in writing that you don't owe them any money, then speak to a manager and lol at them. Lol and moan and eventually they will probably give up.

Their Exceed Insurance system is pants, always crashes or miss quotes and is generally is rubbish, so don't be too harsh to the poor Customer Advisor on the end of the phone as its ain't their fault.

I know this as I deal with 100s of issues with it each month !

Did you pay them for a year up front or take finance with them and are paying on monthly instalments?

Sounds like monthly as it's cover for start of one month to end of next. When I used to pay monthly I'd pay one month in advance, not in arrears...ie I'd pay at the start of August for August, then start of Sept for Sept. Not start of Sept for cover in August.

Although saying that is actually slightly wrong. As you're paying monthly finance for the whole thing, rather than paying for monthly insurance. So paying in arrears is entirely possible.

Had a rummage around for the letters last night, the letter I have is dated 30th June which states that all premiums are upto date and because of cancelling I was entitled to a refund of £48.35, at no point does it mention that I owe money.

Having spoken to them, they say payment was in clearing but didnt go through, my bank have no record of this and no notification was given that a DD hasnt gone through (bank charges for failed DD's).

Because I have a letter dated from the date of cancellation which does not state anything about premiums owed and does infact say I was entitled to a refund, then I think I have every right to tell them to take a hike!

No idea as I cannot find that bit of the documentation. Surely though if when I cancelled the policy on the 30th, regardless of money being clearing, if they don't have the money then I owe it still. As this was not mentioned and that infact I was due a refund which I did receive then they are quiet frankly talking out their ***.

Popped into my bank on my lunch break and spoke to them regarding this issue, Aviva requested funds on the 27th June, this was due to clear on the 3rd of July, so when the policy cancelled on the 30th, this was still in clearing but they never mentioned it, they never said I still had a premium due to come out of my bank and stated I was due a refund of £48.35 which I did receive on the 3rd of July, the Direct Debit was cancelled on the 1st of July.

Because of the hassle they have given me I am now inclined to call them up and state these facts along with having a letter saying they were refunding me etc because this is clearly a mistake on their behalf and I refuse to pay it now, almost a month later.

Aviva are idiots. You're probably paying for the £4k worth of hire car I had due to their mistakes.
