Been approached about one of my shots

Hi guys,

I've been approached by someone from Flickr, regarding one of my shots called "Sherbert Swirl" (Small version below).

The person in question wants to use my photo as a background for some business cards. She claims to be a housewife who just makes cakes and cookies and she'd like to use my shot. Free of charge, of course.

My initial reaction was to tell her to sling 'er 'ook but having thought about it, I can see no harm in letting her use the shot. After all, I'm not in this game for the money!

Would I be wrong in insisting in a credit on each business card in exchange for letting her use the photo?

Well if I were you I'd just let her use it credit free. I know it seems unfair but at the end of the day it's not like you're going to get any actual recognition from it. Plus if you say you want you're name somewhere she'll probably tell you to sling '** 'ook, after all it's a business card and she probably doesn't want to be 'promoting' 2 people.

Think of it as a nice helping the community gesture! :p
 
Be careful, there are people on flickr who will try to get freebie images for commercial use instead of using the agencies/own means.

Its a really nice picture, I personally wouldn't let a shot like that end up on someones business cards for free, especially someone from Flickr who claims to bake cakes and cookies, it doesn't seem 100% koscher to me to be honest.

If they're asking for a full-res version i'd be wary, as the low res one would be good enough for a business card anyway, and they could use it without telling you, if its a tiny business for someone making cakes the chances of that are one in millions...

I'd just be careful..
 
I'd just be nice and let her use it. She took the time to email and ask your permission, there's a lot of people out there who'd just 'right click, save as' and use it without you ever knowing.

Legitimacy is such an alien concept in this world of copyright infringement!

if your not after money then let them use it as long as its printed with your website url or something on there gets you some hits and gives them what they want.

and tbh its nice to see people asking to use stuff from flickr other than just taking
 
Credit it. Unless she's a photographer, i can see no reason why she would mind having a small credit on the card. If she doesn't like it, gently remind her that you could sell your images for business cards for tidy sums of money :P

Ask for a card for your portfolio too.
 
I certainly would not allow her to use it without signing a waiver to the effect that it is used with your permission but that you retain copyright in the image.

As has been said above, it would not be unreasonable to mark it unobtrusively with your name and ask for a "proof" copy of her card.

I would also consider making up some business cards of your own and giving them to her in case anybody asks her where she got it.

It is to her credit that she has asked your permission so with the provisos above it would not seem unreasonable for you to allow her limited use.
