Big issue with Havik 140 cooler, help?

I purchased the havik 140 cooler from Overclockers UK and the cross bar to secure the heatsink doesn't fit. It's hard to explain since I can't take a photo of it. But where the cross bar is meant to screw in, no matter what I try it just doesn't reach it. It seems the screwing in mechanism is to short and so won't fit.

I followed the manual and watched many tutorials since I'm not as much of a pro as some of you guys on here, however this issue didn't happen with any of them (1 customer review on another site did report this issue).

My motherboard is Gigabyte GA-990FXA-UD3. I purchased this fan yesterday (Thursday). Unfortunately the box got ripped so I'm not sure overclockers UK would accept a return. Has anyone else heard of this issue? As far as I'm aware my motherboard should be supported.

UPDATE: A reader pointed out a glaring deficiency with the NZXT mounting brackets when the heatsink is installed 90-degrees to the standard AMD socket AM2/AM3/FM1 mounting holes - in other words, installed so the fans are blowing front-to-back.

In this orientation the length of the spring-tensioned screws on the bracket that rests over the heatsink base are insufficient to engage with the screw studs on the brackets attached to the motherboard. Thus, the heatsink is impossible to install.

The work around (which is not detailed in the user manual and may not suit all motherboards so use at your own risk) is to rearrange the metal brackets somewhat; invert the AM2 brackets and put the Intel brackets on top, then screw everything together as outlined in the manual.
