bios keeps on resetting

Hi all. Is there any other reason my bios would keep on resetting itself, other than the battery? I replaced the battery and it still keeps on doing it. If I turn the machine off and on straight away, or reset it, the bios is fine. It's if i power down and leave it for 10mins plus, I have to setup the bios all over again - it goes back to standard settings, including date and time.

I do have the profile saved in the UEFI so it's not too bad getting settings back, but it is a pain in the bum.

This is a new build.

1090t
asus m5a97 with latest bios and all latest software
4gb patriot ram
windows 7 64

The CPU is overclocked to 3.8ghz and stable, but this happens even at stock.

Any ideas? Google search shows up very little.

You were right. Absolutely no jumper pin to speak of on the cmos pins. Not to be found in the mobo box either. Is that normal? Should i complain to the retailer? I just took a jumper from my old motherboard and problem seems to be solved.
