brake Checked!

Lol driver leaves insufficient gap flashes lights at other driver and you want someone to defend him. Brake checked or not he brought this on himself. As can be seen when he thinks he can't stop in time just before the crash and takes up a central position. In a hurry somewhere by any chance. Good luck defending him
 
Lorry driver was driving too fast and too close to the car in front for the conditions. He crossed the double white line avoiding the car the first time. Clearly should not be driving especially not a truck I would say it was dangerous driving tbh.
 
Far too close. You negelected to mention that it was dark and wet. Your driver should have backed the hell off after about 1:50.

Yes, it did look like a brake check but it could easily have been a real need - an animal in the road or something.

That said, I think you're being a good manager by trying to stand up for your staff. Unfortunately this one is a losing battle.
 
I tend to agree the driver was driving fine, then for some reason closed up and didn't drop back, looks like he had to brake quite hard as a result of this and the guy in the car in front took umbrage with this.

The guy in front looked like he was driving very close to the car in front of him so its a bit ****** since no way was he driving with decent stopping distance either.
 
The car ahead is indicating to turn left well in advance, the lorry drive seems to think the car he hit should have swing out to overtake it as it slows but the hatched zone presents a danger of someone approaching from the opposite direction wishing to turn right.

Clearly lorry driver fault and error of not reading the road ahead.

You need better drivers and cameras.
 
The fact that the truck driver darted into the middle of the road at the junction to avoid what was almost his first accident would suggest that your driver can’t actually drive.

Clearly a bell of the highest order to be driving such a heavy vehicle like a tool in the wet. Should be a sacking on top of the insurance claim IMO, as driving like that is bad for company reputation.
 
I'd give the footage to the insurance anyway. Let them decide. For sure the Car brake tested him which is an offence. I'm sure on claims forms it asks whether the accident occured whilst an offence was being commited

I'd see what @Scania thinks from a HGV drivers point of view

The evidence does show he was too close (he didn't have time to stop) But how much lens compression is there on that dashcam
 
How can you even be sure he was brake checked, having huge lorry flash you that close is likely to startle some drivers, especially if they didn’t realise they were there.

you only have to drive down an national speed limit country road to see drivers dab the brakes every time a car comes the other way. Doesn’t mean you can plough into them.

Imagine in there had been rear passengers, how do you think the police and coroner would have viewed it?

The car in front was clearly slowing down to let the car in front of him make the turn. Your driver looked as though he moved out in an attempt to overtake, and also provoked him by flashing his lights.

I take back what i said in my earlier post, i wouldn't send it to the police as you may well drop your driver in it for driving without due care.

Pretty open and shut case with the insurance company though.
 
Thing is the car accelerated away and then slammed the brakes on for no reason. I don't think it would go against the lorry driver in a legal way. It looks like a crash for cash scam and they have probably done it before, he need to be investigated tbh.
 
I'm guessing insurance wise it comes down to.
Proving the car driver purposely "brake checked" Vs legitimate braking. Or proving the truck was too close.
Car could have sneezed, been dazzled by the trucks lights, dazzled by oncoming lights, thought he saw something.
Truck too close is obvious and zero excuse.

What I really don't get is why some truck drivers think it's acceptable to punish someone for even brake checking by slamming a truck into them.
Like someone has said imagine if there were kids in the back.

Why can't everyone just drive a bit more considerately. Not everyone knows where there going or has the best skills. If that car was in front of me driving so sheepishly I'd be keeping well back.
 
Your driver flashed them near the beginning as well as just before the collison didn't they?
It's pitch black you've got no idea why the car in front hit the brakes, but we do know that your driver isn't a very good one.
 
It might not even have been a “brake check” - maybe they thought they were being flashed because there was something wrong with their car, they panicked and braked?

Very poor driving by a so-called professional.
 
Aggressive driving by the lorry driver. Wanted to keep his momentum and felt inconvenienced therefore took his attitude out on other road users.

A professional driver should know better, sure it's inconvenient but so it someone losing a family member because someone was driving on someone else's time and doesn't care about other road users.

Same goes for the other driver though, right up the back of the car leaving the carriageway, deserved to be in an accident for that and his brake check. But the lorry driver should have seen this and driven accordingly. Day gets a lot longer when you have to mop up the scene of an accident.

Thisexact behaviour has cost many lives on a local A road, so easily done. As I've got older ive started to hang back and plod along rather than get bothered about slower or poor drivers. I make progress as fast as conditions allow, no point having a chip on your shoulder because someone else is not driving how you want them, just asking for a day in court and a tragedy engrained in your mind.
