Brand new laptop-not charging

I've just brought a Medion Akoya P6637, and it arrived today in the post, with a 58% full battery. I plugged the charger in to charge it, but it doesn't "fully" work. I say fully, because it worked for about 5 minutes, but after that it stopped working. It's now plugged in, and **** down, and what's happening is that it's charging, but only seconds at a time. So it will charge for a second, then stop. Then start, then stop, and so on. I've tested the PSU with a voltage tester, and it's fine, so is it a defective battery? Or is it the charging port? Thanks in advance

If it's brand new mate get them pick it up and replace it saves messing about

Something sounds amiss for sure though.

Windows 7 or 8? there is a known bug with 7 where you sometimes have to remove(reinstall) the ACPI device to get it working properly i.e. as documented here:
