BT Broadband contract question

Where in our contract / terms & conditions does it mention that for our 'Unlimited' service they will be limiting our service at certain points in the day and for certain applications?
 
My parents just switch to Sky as recently BT have been either using traffic management or not providing enough capacity. They now pay £5 a month and get 6 times the speed they got from BT just before they left. It is fine for the web browsing they do.

In my case:

We may restrict you to 30k for most of the day even though you are paying for 8mb!

I just don't get it :confused: If they can't give us 8mb's then don't offer it to us!
