Can I buy the upgrade version?

I am planning to build a new pc as my old one just died.

My old computer had xp installed, I may have the xp installation disk somewhere.

To use the upgrade it states you need a prior installation of xp installed. However my understanding is that when installing win7 on an xp machine, the first thing you do is delete xp. Thus is xp in any way required for the win 7 installation?

Is the requirement that you have cp purely a legal one?
 
I have a Windows 7 Ultimate upgrade version and I was able to install Windows 7 on a clearly formatted drive very easily.

The Method I used was the Registry work around. My Main HD with my OS on decided to bite the dust, so I quickly bought a new HD and did the steps in that link.

Saved me a lot of time rather than installing XP and then upgrading.
