Can I return an opened XBox?

Just wondering, I bought an Xbox360 the other day to play Forza 3. However the game is poor, the xbox is'nt brilliant and I am left with an overall disatisfaction with it.

Looking on the high street retailers website it says I can return hardware within 28 days if still sealed. It doesn't say anywhere about returning opened products.

Now with the game I am not bothered, I'll happily take the hit on that but the console itself, I still have the box, the plastic wrapping the cables came in etc. and I have used it 3 or 4 times.

Anyone have experience returning something to a high street game retailer?

Don't think you have any legal right to a full refund returning it to a high street shop, it'll depend on what their own policy is with opened products.
 
If its faulty or not fit for purpose then you can return for a refund. You have a lot more rights if bought online than instore...

Sounds like it's in full working order and fit for purpose though, in which case there's very little that he's entitled to. In fact, even if it were faulty or not fit for purpose he still couldn't demand a refund.
 
Because it didn't live up to my expectations? Where I work we take things back no questions asked if it has been used.
 
Its one of those things, if its not broken then its hard for them to sell it on, you should have test drove one, like you do with cars.
 
Out of interest, are you a PC/Wii/PS3 gamer? If so, what did you find lacking in the 360 which the other platforms have?

I've never owned a console before now. Only ever had a fairly decent PC in the past so had a G25 and a lot of driving games which kept me entertained but was looking into Forza etc. which looked really good from reviews and word of mouth but sadly I do not like the controls or the gameplay itself.

The media center was another thing that drew me to the xbox but it's really buggy and is laid out in such a poor manner, I have to have all my tv shows under the videos section, it's slow as well :( and I have a lot of generic videos I watch as well and when I try and load it in MCE it freezes the xbox.

Why do I have to keep it if I'm not impressed by it? How could I have done anything different except buy it and try it?
 
You should have done your research before buying to see if it would meet your expectations...

How do I demo a game that I have to buy the console to play first?

Anyway before this thread descends once again into berating the poster I'll just suck it up and see if I end up liking it.

Hang on, your opinions on the game aren't the console's fault. I don't think your going to have much joy with a return here. You don't like one game and are going to take a whole gaming system back. Seems silly buying a console for one game only. Why did you not buy rfactor or live for speed for your pc instead?
