Can i return graphics card for refund?????

I bought a X800GTO2 LE on the 23/05/06 from a local shop. before i bought it i Read an article about it having an R480 CORE and thought i would get it
Only to find it has an R430 CORE and to say im miffed is an understatement
So i basically have a x800xl when i should have had a card i could push more near to a x850xt. I can only get to 490gpu/560ram fan 100% before it gets very unstable like resetting VPU what is my legal status of returning it for refund? So i can get the connect 3D 1800xt 256mb on offer for £164.44 from ocuk as it looks like a awsome card also i payed £132 for mine and now i feel i have made a HUGE MISTAKE am i stuck with this card :( ? I have also let ATI +SAPPHIRE know what i think and they are not really helpfull
 
You cant expect ATI or Sapphire to help you because you bought a card to overclock and modify it, only to find out it doesnt overclock or mod how you like.

There are NEVER any guarantees for overclocking or modifying cards. Only if they are pre overclocked.

If you want to refund the card then you are entitled to your money back if you purchased it within 28 days IIR.
 
You cant return a card for being a bad clocker, and if you go to the shop and say thats why you want oyur money back youll be told where to go as OCing a card invalidates your warranty.

If the card is generally faulty then return it, otherwise dont bother.
 
I didnt actually tell ati+sapphire i was overclocking i just said i wasent happy
i had a r430 core when they did have an r480 and that i wasent happy they changed it +no info on there website about it

also about them not liking overclocking why do they put overclocking software in with the card?
 
sorry to hi jeck the thread but ive got a question and instead of making a new thread ill dump it here.
i bought a gfx card online and i had to send it back for RMA the next day, now what are my rights with this? am i entitled to a replacement card asap or am i subject to the same 10day+ process as a normal RMA? and if i end up getting a faulty card again am i able to demand my cash back? is there a 7 day or 28 day time limit for this?
 
dave00, your only chance of recourse is it the card you bought specifically was sold as a X800GTO2 with a R480 core. Regardless of anything else if it did not have the core it was advertised as having you are entitled to a refund. If it was not advertised in such a way I am afraid you are out of luck.

Fullfat, under all circumstances in which you purchase something that does not fulfill the criteria that it was described as meeting when it was sold (in this case by not working) you are entitled to a full refund. You don't even have to accept a replacement once. Also all costs you incur as a result should be borne by the company responsible for providing you with faulty goods. In practice though most companies have specific policies designed to make this last part difficult. Once in a while they'll get caught, but it doesn't outweigh what they save by being obstinant and not reimbursing the other parties reasonable costs.
