So ive got a new 9820x, its defo a 40 lane cpu

I also bought a new X299 Asus Strix mobo

I have used the 4th PCIe slot (short slot) i think its x4 for my ZXR sound card

this then deactivated my 7th 8th SATA hard drive ports ( the last 2 sata on the bottom of the board)

Now im thinking a 40 lane cpu should not deactivate the sata ports just because im using a PCIe slot

My last mobo Asus Strixx X99 on a 40 lane 5930k, I used all of my slots and all of my sata ports

Why is this mobo restricting me,?
 
This should be detailed in the manual, what does it say?

i smashed through the manual, no detail

but just noticed this, on the 1st page of the manual, motherboard specifics, on the expansion slots:

*PCIe 3.0/2.0 x4 slot share bandwidth with SATA 56 ports and SATA 7_8 ports when use device in x4 mode. Adjust BIOS settings to use SATA devices

(thats the 2 i cant use)
 
So there will be something on the bios to use 7&8, should work albeit with limited bandwidth.
Might be worth a question on the Asus forums.

Can you not just use the very bottom slot ? The three full length slots don't share resources with anything else from what I can see.

What that means is that you can set the x4 slot to run at 1x in the bios so you get the sata ports back. I had that "feature" in my past couple of Asus boards. Can't you just stick the sound card in one of the x1 slots? I have my Soundblaster Z in a 1x slot on my board and there is no difference to running in a 4x slot.
 
Your sound card is only 1x slot anyway, so why are you trying to assign 4 lanes to it? As pastymucnher says, just set the slot to 1x mode (that's all you need) and you'll get SATA 7 & 8 back.

yes i have moved the ZXR to the last PCIE slot the longest one on the end, i didnt get that message stating sata 7-8 ports are lost, so I have one full length slot left and the x4 slot, I have one more device left, its a PCIE wifi adapter, the Asus AC68, im gonna install that on the longest slot, only issue is its so close to my GPU

I suppose ill have to go to the bios and change the x4 to a x1 so i dont lose my sata 7 and 8
