A car that was type approved should pass an MOT even if the regs change IMO. There are vehicle specific exceptions, I believe - in fact in that article they talked about the end of the exceptions for quad bikes with hydraulic parking brakes so they do exist. I wonder if these will apply.
 
My 2010 Polo does not have headlight washers, will that fail an MOT when the time comes?

Surely you would only fail an MOT for no headlight washers if your car did have them fitted but they were not operational/no fluid etc.

only if you have xenon HID headlights fitted.

Which it doesn't. Any car produced in the last 5-10 years with xenons from the factory has the correct self leveling and headlight wash system.

Astra VXR for example, didn't have xenons as standard, but they were optional. Many have bought second hand cars without them, then retrofitted with non VX parts so it doesnt have the headlight washers or self levelling.

This car can be fitted with HIDS, so the astra vxr is type approved. How are MOT testers supposed to check if they had it fitted at the factory or not ?

As Fox said, HIDs in reflector lamps is the real issue. Headlight washers are usually rubbish, and self adjusting isn't an issue when you correctly adjust the lights manually. Besides, some cars are coming with self levelling rear axles anyways.

I think you mean reflector lamps with fresnel glass. There are many reflector lights with HID's as factory standard. These are shielded ofcourse.
 
Was on my second MOT today and in walked the VOSA Commisioner for a surprise visit!! He watched me finish the test then took it in and checked it over again. All was ok though, didn't miss anything and he agree'd on the advisories.
I asked him about the 2 year MOT thing and he said that was a government idea, and that no one in VOSA supported the idea, so that basically means it won't happen.
