Car Hit by Drunk Driver

She wasn’t hurt at all luckily.

They never are... it's the family of four they head on who usually end up in the fridge at the mortuary...

Did they say what she blew?

Ah well, hopefully the insurance write your car off then come after the drink driver with civil proceedings for the £15,000 or so it's cost them.
 
The car hasn’t been driven since the 23rd as I’ve been on holiday off work since the 19th

Gotcha, never realised those discs would rust that quick! Such a shame, I'd want a new car if I was in your shoes. That kind of structural damage will never be 100% right again imo.
 
Sorry to see this. But it is a bit much to wish death on someone for drink driving and hitting a parked car...

Not really, from my experience people who drive drunk will do it again and again and again, need to remove the threat of her from society or are you happy that she could wipe out a couple of pedestrians or wipes out a family head on next time.

As people have mentioned she must've been tramming on to do that kind of damage so imagine if she hit someone.

No, the roadside ones only give a pass or fail. They then get taken to the station to get a proper one done, so don’t know after that.

If they wrote my car off I hope they give me more than £15k for an E43 that’s less than 3 years old, never mind the 2 other cars she’s hit also. :eek:
 
I hope you have gap insurance. Anyway, just speak to your insurers and let them get the ball rolling.

Why would gap kick in? Surely with OP not at fault then all costs/value to put him back to square one will be upon the 3rd parties insurance

I thought GAP was to cover you if YOU were at fault and make up the difference to cost?
 
was there a big kerb she clipped , that took out her wheel
... you wonder what speed would need to be, might be surprisingly small ie 30mph

Nah I mean the total cost to her insurance company for the damage to your car (if they give you £30k for your car, then sell it for £15k to a breaker or something = It's cost them £15k) - they'll obviously pay you out whatever it's worth.[/QUOTE]

I don't think you'd need to be going that fast to do that damage. 20MPH would probably do that amount of damage if the wheel hit the wheel. A lot of mass being shifted around.
 
So sorry to hear this OP! At least no one was hurt if there is any positive to take from it. However, They should throw the book at her, followed by the library, book by book.

Be prepared for some insulting offer of payout. See my recent thread, have examples same age, mileage, spec, condition at the ready and refuse to budge until you can be put into a car you are happy with.

(assuming he bought new) third party or otherwise is still only going to pay 'market value', they won't be paying him invoice value for a car he's had three years of use from.

They're obliged to put him back in the situation he was in before the accident, either by repairing his car or giving him a write off payment that will allow him to buy another 3 year old E43.

They're not obliged to put him in the position he was three years ago buying the car new.
