To cut a long story short, mate had an accident -not his fault, whilst arranging a hire car with insurance they checked his details.

Turns out he had a speeding conviction from 6 months ago he knew nothing about 3points (49 in a 30) £60 fine

and an ms90 failure to identify driver £415 the magistrates want from above fine

all this because he just moved house and didnt tell the DVLA which hes now told them, so is looking at £1000 fine for that too! no mail was forwarded from old address.

so potentially 6 points and £1500 ish fine just for not filling in a form, is that right?

You cannot be convicted both for a failure to identify driver AND for the speeding offence. It is contradictory and an 'abuse of process'.

Also, how does he know that it was a 49 in a 30? His license details won't hold that information - only the offence.

interesting, so if your offence is for >3 points and you ignore the NIP you only
get 3 points?
Accoring to the the other post this evening travelling between 11 and 20 mph faster than a 20-30 mph speed limit, guidelines suggest that the magistrates endorse with 4 or 5 penalty points

Exactly. So it would probably be better not to fill in the NIP at all in those circumstances as you will only get 3 points max.
 
But...insurance companies generally don't like the MS90 penalty code you get for failing to identify the driver, and of course the maximum fine is £1000.
