Checking Diagnosis on temps

Hi, I've just replaced my socket 939 chip from a single chip 3200 to a 3800+X2, which i got second hand. The rest of the setup has remained the same.

Problem is that the chip seems to get too hot and hangs the system, unless I leave the case cover off (its a silverstone sugo sg-1, so a bit cramped). With the case off, I have core temps of 46 and 50, and the temp probe on the cpu cooler reads 36. With the case on, I have core temps of 52+ and 56+ (not sure how high it gets before it hangs) while the cpu cooler probe reads 38.

Now, I believe the problem is that the ihs must be not too flat anymore, and the contact is wrong between the cooler and the chip, and I should lap the ihs.

Before I do this though, I'd like to check the possibility that its not because the previous heatsink had been removed improperly and pulled the actual ihs away from the chip, and that I'd have to cut away the ihs and redo that.
 
Have you changed the heatsink or are you using the same one as you had on the 3200?
 
It's possible that it may not be good enough for the dual-core, and the extra heat is raising the ambient temp of the case and making things even worse. Tho the X2 3800+ shouldn't really give off much heat.
