Back in October a HGV clipped my passenger side rear, span me round and caused ~£8k worth of damage to my Z4. The car has since been repaired by BMW and I have it back, so the insurance companies are preparing to argue about it in court. We've gone from them blaming me to them wanting to go 50/50, so the claim is heading in the right direction.
Anyway. Part of the repair was two new rear wheels and one new rear tyre. As the second rear tyre wasn't damaged enough to be replaced the insurance company only paid out for one, so that's all BMW fitted. Two things bothered me about this:
- The new tyre and old tyre had massively different tread depths - brand new (8mm?) and just over 4mm.
- The old tyre had a small gouge in the sidewall.
I spoke with BMW who decided that having those two tyres wasn't a safety concern, as they were both the same brand, same model and reasonable tread depth. I took the car to my local tyre guy who disagreed and said he'd change it, because the gouge was borderline and I drive a 340bhp rear drive car.
So, I changed it, out of my own pocket. When I got my insurance policy they offered my their legal cover for only a fiver more, so I signed up. Since the accident I've been sent lots of literature telling me I can claim for other expenses I've incurred, like transportation costs, loss of earnings, excess etc.
Would the people here claim for the cost of a new tyre? Or is that a pointless attempt at getting a free tyre seeing as the repairing garage deemed it needless? I've already asked my insurance company and am awaiting a reply, just thought I'd get a second opinion here.
TL;DR - Had accident, insurers only paid for one new rear tyre, got second rear tyre replaced anyway. Would you claim for cost of second tyre through insurance legal cover?
