Clamped for no tax disk on display

The car is taxed and in a secure underground car park, however it has been clamped. Was told it was because it had no tax disk when i mentioned a note had been made saying so. Got back to me and then claimed it was because it was in the wrong space, quite how they know this is beyond me as there is no permit or space registering system here.

So are they trying to pull one, the car IS taxed and the tax disk was on the passenger footwell. They are not the police even now a NPR check would have showed it being taxed.

£85 release plus £80 for arrangeing the tow truck and space for it to be removed. Thing is that there is no way a tow truck would fit in the car park.

Only reason i parked in the unused space was because someone was in mine when I got home last night and the car park is only ever half full anyway.

Oh and now I am waiting for the 'release engineer' to turn up. Talk about Engineer being overused in job titles...

I have thought that, it's the official Reading council clamping people though, apparently it is a redroute too. I will though if he gives me any crap.
 
What was it doing in the footwell. Bad luck I guess. I know you have to display it at all times, and even the police would have picked you up on this and fined you depending on the plod who would have noticed it.

Seems particularily harsh, but they are going on the above ^^^

Maybe pay it then send a stinking letter to them and a couple of car mags, police won't care.

Thing is permits don't exist for people in my flats! Complete farce of an operation. Clamping cars because they have no tax disk on display despite being taxed. The police wouldn't clamp me, infact I doubt they would care as they would know it is taxed by the numberplate.


Its a metal disk holder that rolled out on the way home yest and landed on the floor. Been meaing to get a normal holder for it.
 
I would believe the council really, I would genuinelly rather believe an official who sounds like they are not BS'ing than someone who might be reading his rights out of a book.
 
I dont think they can clamp you for having no tax as thats a police matter, not a civil one.

Sounds to me like their trying to pull a fast one, so I would personally contact your local police station and say that someone has illegally clamped your car. Even if the police don't do anything it might scare the clampers into letting your car go.

Besides which, if you're in a secure underground car park what need is there to show tax?

Has some note about some 6months in prison or £5000 fine for removing the clamp for criminal damage, I have just looked at it. It it so badly fitted i Can slacken the chains and then get to every wheel nut. take the wheel off, take the suspension apart and remove the clamp without damage. Plan B i think :)

Exactly it's not public property so I can park with an uninsured untaxed banger for all they care. The permit system is a farce, he doesn't know if I have permission off the other flat or not. Even so that space has never had another car in it during the 9months I have been here.

Rang a bit ago and they will be here at about 10:30. Im trying to find the caretaker soon
 
In a completely no recommending way, I'd be half tempted to refix the tax disk, say 'its taxed, what are you talking about' and see what they say. They can't say 'you just went and bought that' becuase I doubt it has exactly 6 months remaining.

At least thats what I read in this mornings Council Excuses Grouptest in What Clamping? magazine.

I did think of that, but then it puts your credibility into doubt and he probably won't believe much else. It's likely to be the same guy who turned up to clamp it. Anyway the tax disk was on disply, just he didn't look hard enough.

Tax disk is valid till September.

That'll undoubtly be the maximum they can hand out for the type of offence, in this case it happens to also be the maximum any summary offence can attract, so I'd assume its (at least in the realm of clamps... major damage may be different) a summary offence only, which means two things, its a masgistrate as opposed to a judge you'd see if you were caught, and unless there is anything in the particular law to say otherwise, then the general time limit of 6 months to lay it before a court for a summarry offence applies.

IANYL - but I fail to beleive they lock up normally respectable members of the public just because they get a bit hot under the collar and cut off a wheel clamp... :p

I can't see any reason you can't do that, other than anything there might be mechanically wise (Not something I can tell you anything on! :o )
