This thread has little to do with ebay, I hat ebay threads, lol!!!!!!!!!

Sold a car on ebay. Was described honestly apart from the fact that it did have slightly lowered suspension. I was selling for my brother and I didn’t realise at the time that the suspension was lowered, the buyer wasnt bothered though luckerly. It turns out the buyer is not happy and has had to have lots of work done on the car. The list inc’s replacement fog lights, engine mount problem, new de-cat, rear wheel bearings, and a couple of other problems. All of these issue neither me or my brother honestly had no idea about. He only owned the car 6 months and sold it as it wasn’t very economical and he needed more reliable (even though it didn’t break at all at any time) economical car as he moved out of town.

The buyer has now text my brother saying he is “going through ebay legal thing” to try and get some of his money back. The car has done 115,000 miles is 10 years old only and cost him £500. Although I admit there is quite a few problems there, I’m not to sure what he expects? Oh, and if anyone wants to know it’s a P reg Meagane Coupe.

Just a couple of questions, if you would answer them for me.

Where do I stand legally?

What would you do in the situation?

And do you think its fair, or for some reason I am obliged to compensate him because his new 155K £500 cars isn’t as new?

He shouldn't have a leg to stand on. Its old, its french, its cheap, it doesn't come with a warranty and you are a private seller.

Tell the seller he can do what he likes but you won't be refunding him.

He didn't pay by pay pal did he? (if he did you're probably screwed)

Keep records of everything (the auction listing, emails etc) just in case.

I doubt he can do much, though.

So he bought the car off you,,, was obviously happy because he had work done on the car? if he wasn't happy he should have disputed it there and then, as your only covered by ebay buyer protection if something you buy is not as described.... he screwed all over that by accepting it and having work done.. wouldn't worry about it.

Its his responsibility to check these things. You aren't a garage and as such offer no warranty. He could have checked the foglights and wheel bearings himself before the auction ended. Sounds like he has changed his mind and wants to recoup some cash. Tell him to go through with his threat, ebay do not offer legal services :p

I've been studying law for two years, here's my opinion:

Where do i stand legally?

Completely in the clear, he has no case whatsoever.

What would you do in the situation?

Ignore it.

And do you think its fair, or for some reason I am obliged to compensate him because his new 155K £500 cars isn’t as new?

Nope, not fair at all. Henceforth, under the law in this country, you have absolutely nothing to worry about.

you should ignore him completely. any reply will just encourage him and cause you more hassle.
there is no 'ebay legal thing'
all he'll do is email ebay and get a standard reply from them or no reply at all.

Thanks for the advice. Will just forget about it and if ebay email me I will tell them how it is. Oh, and he paid cash so there is no problems there with payapl.

thanks again, :D

As has been said don't worry. You don't buy a 115000 mile car for £500 and expect it to be 100% perfect unless you are a fool... which this guy obviously is. Unless he asked a specific question ie "Do the fog lights work" and you lied in your response you have nowt to worry about.

Keep us updated on this please. I'd love to see how it turns out (although I agree with everyone here that you have very little to worry about).

I wouldn't worry the guy is probably full of poo. Just ignore him. What the heck is ebay legal thing anyway? He can open a dispute but it's not going to go anywhere and I can't see him having any luck if he decided to chase you thru proper legal channels (which I doubt he can afford to do anyway if he owns a P Plate Megane!!)

Of course I will, but cant see it coming to much though as people have stated.

Thanks everyone!

What does the guy expect for £500?

If he didn't want a 10 year old car that is OBVIOUSLY going to have wear and tear parts near the end of their life, and isn't prepared to get a full inspection - then he shouldn't have bid on it.

He's just trying it on, he won't get anywhere with eBay.

He bought a 10 year old car with 115K on the clock for £500, and didn't expect to have to spend any money on it? He sounds like a tool of the platinum plated variety. I don't think you've got anything to worry about at all, you're not a trader and it's a private sale. If he wasn't happy, he shouldn't have handed the cash over.
