Copyright & ownership

Hi there,

I am new to photography and took my new D50 and 55-200mm nikon lens to the Manchester Pride parade and took the following shots:

Question: First image was a classic (to me) and I was advised to send it to see if it could be published (somewhere appropriate). So who owns the copyright ?

I dont have a release and have no clue who the person was, as such I am reluctant to do anything.

Comments please.....
 
You can send the one with the fello sticking his finger up no problem. as for copyright, i am not sure how you would embed it in the image/exif.
 
well they say if it is not a recognizable face i.e blurred/back of the head/obstructed then you dont need a model release. you should be fine. submit it before its too late.
 
I thought the rule was that pictures taken of people in public places where anyone could have seen them were fine and didn't need an explicit release from the subject(s)?

In other words, if you took a picture of a crowd scene you'd not need the consent of everyone in it to publish it.

But then I could be talking utter twaddle :D

So from what has been said I guess I could do what I want with all of the images since all were taken in open public (and some even mde eye contact for the photo's.

I would like to do something with the first image since it appeals to me but I dont know why other than the finger and the slogan on the T-shirt.

As I said i am new to photography with an SLR and have only ever made what could be called snapshots. So i am quiet flattered that someone suggested that I (they on my behalf) try to get the finger one published. As for ££ i am not bothered I am just flattered that someone liked it beyond a snapshot.

As for manipulation they have only had a border, title & name added.

No, seriously, that image is ok to use, I'm pretty sure. You can't see the guy's face, so it should be fine ;)
 
Ok. Photographers always own the copyright to their photos no matter what they take the picture of. There are of course issues relating to what you are allowed to take a picture of though. Taking pictures of random people on the street can be used for editorial use but not comercial use and its generally a good idea to get their consent. At the very least their name on a bit of paper is enough. For comercial use you would need a model release form. I'm not 100% sure on the details for things like events though as you can't quite get the persons name for editorial use. I'm sure its perfectly fine though. The main problem if you don't get their consent is if you then use the image in a deflamatory way. Like if you posted the pic on a forum, or newspaper or something saying "here we have a bald idiot". They can then sue you for emotional distress. As long as someone can prove a loss in a court then you're in trouble.
