Copyrighted samples on Myspace

Figured someone on here would know about this one. Say I wanted to upload a song to a band/music profile on Myspace which featured a copyrighted sample, would that be a breach of terms? EVEN if said sample was taken from a Youtube video which is already in the public domain (legally or not!)? Would a mere reference to the source suffice?
 
Im no legal expert but since you mentioned it being copyrighted, then you would probably need written permission from the author of that sample.

Just because its avaliable freely on the internet doesn't mean you have the right to reproduce it without consent.
 
The chances are you'll be fine. Material that you've taken from the internet for free is still covered by copyright, so I'd say that you're not allowed to do it. However, the chances of you getting caught and stopped are extremely slim. I've got covers of whole songs on my MySpace (granted it's not samples from an original track) and have had no problems.
 
A lot of breakcore music uses copyrighted samples, I doubt many are cleared either... The thing is, it's underground meaning they won't sell very much so they are unlikely to get sued...

I think ****mat's "Full english breakfast" album did sell 10,000+, even tho it's got samples from the Snowman, Captain Pugwash and allsorts of other mentalness! :D

Just type breakcore into myspace to see what I mean...
 
Thanks for the replies. Still a little unsure, sounds like I shouldn't but its a bit of a "who cares" situation :D. No profit is made on my part from this if that has any relevance, I wouldn't be putting it on Myspace if I thought I could sell it ;)

Loads and loads and loads of DJ/producers have bootleg remixes available to listen to myspace. None of them will have had permission to use the original track i'm sure.

Just stick it up you'll be fine

(EDIT\ A techno producer i used to work with had a track released that sampled sound bites from Batman Begins, he didn't even get permission for that despite it getting a full release)
 
To answer your question, legally, you will be infringing their copyright and thus could be sued.
