Creative Commons Query (+Rant)

Hi,

I'll give a warning before hand that this isn't actually HTML/programming help as such rather a request for opinions about a license for a web template ("Creative Commons 2.5") so I wasn't exactly sure where to post it.

I was pitching for a web design job, against another designer to a group of people who probably wouldn't even know how to turn a computer on. To cut a story short, a few days later the other designer and myself take our mock-ups in, and he gets chosen... which usually I'd be fine with and that's the end of it. But this guy, instead of making anything himself (like I had) just downloaded and printed out 3 free templates from oswd.org removing the original author credits and adding his own name/company, and because he didn't actually need to do anything himself was able to undercut me by £200.

The site is now online, still using one of those 3 templates, with the original authors credit completely removed and replaced with his own name, plus his mish-mash of nested tables for positioning the content within the template ruining what was a perfect clean tableless layout. (the main layout he used is still tableless as per the original, his content isn't - I don't think he even knows the difference, his content was added via frontpage)

Is that a violation of the creative commons 2.5 license? (<--- That was the question, in a sea of rants :p) Which says, to quote:
free for:
non profit
and/or
individual use
I don't really mind... I just wanted to know peoples opinions because it would amuse me to see him have to take it down and start again.

What's even worse is this guy is a university lecturer for web design, I dread to think what he has taught his poor students.

Sorry if that turned into a bit of a rant, but there seems to be way to many "designers" selling freely available templates these days just altering the credit lines and sticking in a bit of content. Anyone else come across people like this guy? (Not personal sites, people who actually sell them)
