CSA troubles ahead

Long story short, Up until the end of September i had both my sons living with me. Things did not work out and youngest has gone back to his mother. Not content with our personal arrangement of me giving her £330 month for him she wants to involve the csa. Typically i just cancelled her pathetic £20 a month payment to me which was for them both!
Any way, i have now paid the £330 for both months since he left but what concerns me is, will the csa count that and any further monthly payments as support or just a voluntary contribution and then backdate any monies owed to the end of september???? ie i will have paid twice!!???
Is it best to stop paying her and just save the cash until the assessment comes in?
By my calculations i am probably a £10-£15 out as i got some bonus earlier in the year and it appears they count that too (as well as the overtime i did the last couple of months to pay for my older sons motorbike etc!!!!!) typical, especially as that particular bonus scheme is now finished and i will not get it again.
On top of this i am paying for both sons mobile contracts and a few other things-she has no idea that they will suffer when i cancel it all.:mad:
The thing that gets me most is i have always paid without question as i believe if you have kids-You support them, The CSA however from past experience will make my life a misery from here on. Only 4 years to go before she gets nothing-roll on!!!

How did you pay her the £330s? Direct into bank, cash, cheque? If you've got some sort of proof it should give them a hint.

However, don't forget you are now dealing with the CSA, you monthly payments will initially be twice your annual income.
 
You don't have to buy luxury items for your kids, they can earn money themselves, or save their pocket money. Teach them the value of money, it's much more worthwhile than a phone or a motorbike.

I don't know anything about the CSA, I guess you'd have to call them.

I'm in a situation where I bought up my eldest son myself and never recieved any maintenance from the mother (9 years), I know that the CSA won't backdate payments, they will only start a claim from when she contacts them/has her interview. This was my experience, but I would seek legal advice asap, best thing.

All to do with income, she paid me effectively £2.50 a week for each son when they were both here. Obviously my wages are a little higher and hence the £330 a month.
The phones were to make life easier when they were both here-just so i could always contact them etc. They will be learning about the value of money pretty fast!
I will now have to reclaim for the one son living with me so i guess that would mean £10 a month from her to me and £330-£350 from me to her!

She is worse than that by a long way, She did the dirty on me in the fist place, definately has an undisclosed income source although last time i tried to use the CSA myself to find out, they told me i had to provide her bank statements etc!!!! Like she will divulge all her info to me:rolleyes:
 
pay buy bank transfer so you can prove what you pay.

1 child is 15% 2 = 20% 3 or more its 25% of your salary that's their rules for a 7 day week so for instance if they stay at yours for 2 nights a week you get to knock 2/7 of the amount.

I was paying the X she wanted more I told her no, she threatened me with CSA I told her to go ahead and the funny thing is I ended up paying her even less than before!

Don't be afraid of the CSA they are bad but its not always a bad thing for them to be involved.

But Make sure you pay via bank transfer or some other recordable method.

As badcompany said, at least with the CSA involved it's a fixed formula, you know where you stand and you (and your sons) can get on with living your lives.

Of course if one of your sons lives with you full time you wife could have to pay you 15% of her nett earnings as well (unless she's on benefits).

Keep in mind the CSA calculation is solely based on nett income after Tax and NI, it doesn't take into account (or care about) previous financial debts, commitments, mortgages or anything else.

There's a calculator for the CSA payments here https://secureonline.dwp.gov.uk/csa/v2/en/calculate-maintenance.asp but to put things in perspective to pay £330 per month for your son (note, this doesn't include any payments of maintenence for your ex) you would have to be taking home £2600 after tax and NI per month.

Generally speaking CSA will back date to the date they first get in touch with you.

As much as I hate having to deal with the CSA I say tell her to go for it.

That way you have a fixed amount to pay each month. My ex has learnt (though it has taken her a while) not to ask for money for shoes, school uniform, trips and the like as the answer is always the same 'use the CSA money you get paid!!!!'

Just think yourself lucky you'll be put on the new system.

Under the new system I'd be paying about £225.00 a month
Under the old system (the one I'm on) I have to pay £418.00 a month

Always make it clear on the STO that it is a payment for your son I.e. 'Support Payment for FULL NAME'

The CSA have been known in the past to not count payments msde electronically unless you can prove beyond shadow of a doubt that the payment was for the child.

I pay her each week and the transfer is name in the name of son, so on my statement each it reads BILLYBOYS CSA MONEY.
 
The CSA go off your net pay. Its roughly 10-15% of your monthly income however having said that since some guy hung himself as he had less than £10 to live off because of the CSA they now take any payments into consideration.

I've managed to get things amicable with my wife, i don't pay any maintenance because i still pay the mortgage payments.

Also for the payment which youve mentioned just be aware that i've heard horror stories of things like that not standing up in court. Hope you get a male judge mate
