Data Protection question

Wondering if anyone here could give me some advice about a situation;

Partner (unmarried @ mo.) has a brother who is married to his wife and has nearly the same name now;

Sarah Jane XXX
Sara Jane XXX

But totally different dates of birth, now on her credit report she has been linked to her brother by misspelling of the name. Now the credit report people have said as the credit is still ongoing it cant be removed from her report.

Now surely thats not right so can I get a copy of her credit report and send that off to the company to get the to change it? If so;

1) Which part of the Data Pro. Act would I use to make them alter it?

2) If they refused could I take them to court? Im guessing I cant take them to County Court as they havent really cost us any money and thats the only thing you can get of CC cant you?

Anyway any ideas/surgestions/correcting me would be appreciated

just use a dissassociation form available from them.

They are not legally allowed to say the data belongs to Sarah when it belongs to Sara, unless they are financially linked.

Write to them and ask them to reply in writing to confirm that they are unwilling to rectify their mistake?
 
If the issue is that a lender/institution is providing information to the Credit Agencies with an incorrect spelling of the name then you should approach the lender/institution and ask them to amend their data under the Data Protection Act requirement that "4. Personal data shall be accurate and, where necessary, kept up to date."

This is something the lender/institution should action, not something the Credit Agency can do as all they do is report the information provided to them.
