Has anyone ever tried to return a brand new item <30 days old due to a defect?

I purchased a brand new watch from Goldsmiths last month and immediately it failed to keep accurate time. Despite being worn (it’s an Automatic) and manually wound to ensure it is powered it fails to maintain accurate time, often running 30 minutes slow.

The first time I contacted Goldsmiths I asked them to replace it or provide a refund but they have told me I need to send it to the manufacturer under the warranty.

Doing some research online I’m under the impression that as the item has been defective since purchase and is less than 30 days old I should be entitled to a full refund under the consumer rights act.

I’ve emailed and verbally stated I want to reject the item and request a full refund and on returning to the store I have handed the watch to them. However they still refused point blank to the refund and insist it must go off to the manufacture for testing as per Goldsmiths policy. I said they could keep the watch in store and see it run slow.

I’m frustrated because it’s an expensive watch and I have been unable to use it since purchase and now face a further delay to getting it resolved. Also further inconvenienced by the fact the nearest store is a 6 hour round trip for me.

Are they taking liberties or do I need to wait it out. Has anyone experienced something similar?
 
I can't help with regards to your rights but I am a Watchmaker and just interested in the make/model of watch.

They are wrong
And fobbing you off with its manufacturers responsibility is oldest trick in the book
You bought it from them
It's them that are responsible
Unless you personally choose to use the manufacturer for whatever reason

Sorry to disagree but
First 30 days
You can reject it and ask for a refund
Or if it's your choice~can ask for exact item replacement
After 30 days up to 6 months
The store has the right to try to repair it
Or replace it should they choose to
With an item not less than
Equivalent
If they can't then its refund but you have to give them the chance
To repair or replace
You may choose to deal with the manufacturer if you want to
But it's by your choice
It's not because the retailers say that is the only option

Some big stores will even forego all that
And if its in warranty /guarantee
They go straight to replace or refund
Immediately
And they sort it out with manufacturers themselves
Much better customer service and good for their
Reputation
 
What brand / model of watch is it? Also, if it's an automatic, why are you winding it? General use should be sufficient to keep it running.
 
It was a Tissot SeaStar Powermatic 1000, Goldsmiths finally issued a refund so will be looking to purchase it again elsewhere.
