Hi, wasn't sure if to put this in here or GD, but anyways.

I bought a broken dell off a customer a few weeks ago (I manage a computer store) and replaced the broken components, and tested it all, as well as re-installing OS.

Now I put it on ebay and some guy has messaged me saying its not a refurb its used, as only dell can refurb there computers and then quoted some sales law. Is he right?

Well if he has quoted law then there is no arguing with it?
I would suggest you look into on the interwebs but I personally can't see what is wrong with posting on an Auction website such as the bay with it being advertised as refurbished if you use a personal account, a business account may be a different matter though...

Sounds like rubbish to me but post the sales law he quoted.

To me refurbished and used go hand in hand, I assume for condition on ebay you have stated it is used.

He didn't quote a law he just stated "for your information and law of salers" after warning me.

Yes it is a personal ebay account, I just sell stuff on there we can't sell in the store.

Domi it's listed as refurbished.

hmmm on investigating he may have a point it does seem that refurbished is NOT used or second hand but I can not find anything that states this as law.

I do think you need to change how you advertise the stuff though as it seems he is correct.

If you know me you'll know I dont like dell. I hate anyone that think they own something after they've sold it to you! This is a good example. Sounds fine to me as it is.

its nothing to do with it being a Dell it would be the same if it was any other make HP or even an OCUK machine.

The argument is that I could take a 2nd hand machine sold by overclockers 5 years ago and clean it inside and out reinstalll the OS and sell it as "refurbished" . The fact is that is used or 2nd hand and it does seem more than a bit iffy the more I think about it.

Very true. But he has stated which parts he has replaced etc. You shouldn't have to be qualified to sell a computer as refurbished.

could you not use a phrase like... " overhauled and repaired by seller" instead? It should make the guy waste more hours studying his law books trying to trip you up. Your not misleading anyone as long as you clearly state the condition and show pictures of the item offered for auction.

My view of refurbished is something that is USED and has been taken/sent to a registered repair centre to have an defective parts replaced with OE parts from the original manufacturer.

Have you replaced the parts with Dell replacements?

found this, your right in what your saying

"Refurbished", in reference to computers or laptops, means that the equipment was returned to the manufacturer either because the customer simply didn't want it or a minor problem was found. Before re-selling the equipment, manufacturers fix and certify the unit and sell it at a discount.

Its a nonsense arguement, as you didnt claim it was refurbished by dell.

'Refurbishment (restoration) is the process of major maintenance or minor repair of an item, either aesthetically or mechanically.'

Who the refurbishment was carried out by, is irellevant unless you specificly claimed it was done by dell.

Just to add, surley you could only buy a refubished dell, that has been refurbished by dell, from dell themselves?

By definition he is expecting the impossible, as the pc would be 'used' if it came to him from dell via you?

Incorrect, there is a difference between 'refurbished' (a generic term - look it up) and saying that something is officialy refubished/re-certified by the maufacturer.

Difference may be that refurbed Dell monitors come with a new 3yr warranty, if ur not offering that may be misleading buyers as it is what they would expect from a Dell refurb.

Yes there is a difference, but it is possible to sell a refurbished Dell computer that isn't refurbished by Dell, as long as it is not claimed that Dell refurbished it.
