Yes, of course his FPS is 60 with VSYNC on and yes of course you can't say what his FPS is going to be exactly with VSYNC off but you can make an educated guess by looking at the GPU utilisation.
Put it this way. If I was driving a car that could do 0 - 60 in 10 seconds when using 70% of the available power, I could make an educated guess that it would do 0 - 60 in about 8 seconds if I was using 100% of it's power. It's the same deal here.

Yea but I really think you misunderstand the problem. As long as Nvidia wins everything is OK :p

That 4k graph has got to be wrong. I get 72 fps locked at 4k max settings with a 1080ti all apart from depth of field turnes off. Just in the tower i see it jitter in the fps numbers but still smooth as hell.
Im overly impressed with d2 tbh. Not the best looking game but the fact i can run it at 4k at its highest settings and the game looks great impresses me. I like it when devs try to optimise of the desktop and i know they have with d2 because ive seen the game run on some low end cards really well at 1080p even 720p. So it scales down extremley well.

It does seem to run really well on older hardware, they need to be applauded imo (in this day of very little optimisation anyhow!). They're smart enough to know that it'll effect sales positively!
 
Probably more impressive that they've optimised so well on a game that is basically a console port. They didn't even doing a port for the first game so to have done this much on the second one is impressive (I've not played it but going from what you guys are saying).
