All well and good, but on the 22nd august, goa announced SE pre orders will not have OPEN UK BETA ACCESS and only CE editions would, now i am not eligible for refunds, so where do i stand legally as this is false advertisement.

The situation then is basically as follows:
Pre-ordering a standard edition from most of our partners will not automatically give you Open Beta access as we have said previously. We will however be announcing a list of 'preferred partners' who will be selling the pre-order with Open Beta access. A full list of these partners will be included with the main announcement this week, I can confirm that both the EA Store and D2D are preferred partners and so those of you who have already placed an order need not worry that you won't get what you were offered.

So now, obviously i have no clue which side of goa to listen too.

Ea store and D2D have been confirmed as being eligble for open beta by the GOA head community manager - part of which you have quoted in your post, certinaly when clarity is required they dont seem to be the best at assuring people :o
 
I signed up for this pre-order via Direct 2 Drive. I emailed them about not getting any beta access keys and they told me it only applied to the North American version even though it clearly states on the website that it is the Euro version so I'm a bit concerned now.

You guys think this means we will get into open beta with this pre-order? Hardly too clear is it?
