Hi all,

Due to poor parking around my way I have squeezed my car into a space that means my rear end is over my neighbours disabled parking bay. The wheel isn't it just the bumper probably less than a foot of my car is encroaching into the bay. Is this illegal?

I am not concerned about my neighbour having less access to her car because of it as she can't drive so rarely ever gets taken out in it, maybe 3 times a year, also she has had the space extended twice in as many years so it's not your normal size bay.

It doesn't matter how many times they use the space, and given that it had been expanded in recent years I would assume there was a good reason for it.

Apart from the moral side to it, no you are not breaking any laws parking in a disbled bay. Police and even traffic wardens can not make you move it, they can ask but not make you move it. I was told this by my local police due to parking issues round my way and my neighbour has a bay.

The only bays that you are not legally allowed to park in are the ones on public car parks.

Park away :D

Is the disabled bay an official council one with signs etc?

If so you could be committing an offence parking in it if you don't have a disabled badge etc

Depends on the bay, if has a sign put up by the council that says disabled badge holders only, then you could be parking illegally. Other bays are discretionary and are not enforceable bays - just there alert other drivers of the need for a disabled person to park there.

Exactly! The real thing you should be considering here is why do you WANT to park that close to a disabled bay that has had to have been extended! I know I wouldn't...
