Give Microsoft a call and shop him after you get your refund. The Xbox support number is free phone 0800 587 1102. You might even get a reward for reporting fakes.

Still got my Offical VGA on back order with a competitor. £16.99 for the Official cable with a £5 off voucher

only thing is the damn wait.
