Dodgy Ebayer or not?

This is what I sent out:

and what I got back:

Honestly it looks like someone took a pair of scissors to the disc.

The incriminating mark is on the black Playstation band down the side.

EDIT:
Just messaged them with:

Hi, I received Vandal Hearts today and was wondering why you have put it in a new case as it is not the same case I sent it in?

I have a high res image of the original auction picture and the case is marked yet the returned case is almost new I would say and clearly not the original.

I thought you were exagerating when you said it was cracked, it appears as though someone has used scissors or something to cut the disc.

While I might have missed a scratch or gouge I think I would have noticed the disc was falling apart. As you stated the packaging was in order I can only assume that you somehow damaged the disc yourself possibly while changing the cases about.

I would be gratefull if you could explain these odd things.

That definatley not the game you sent him. He bought yours because his was broken, then said what you sold him was busted and wants his money back.

He can go run and jump mate. Definatley trying to pull a fast one here I think.

Considering the worth of the game, I wouldn't trust him, sounds like he's pulling a fast one.
I had similar problems when I sold Suikoden 2 (another pricey PS1 game)

Number 2 or 3 I think. Don't back down, you know you are right. You've got evidence of what you sent out, and you've got evidence that it probably wasn't damaged in the post.

should have writtin down the bar code on the back of the origional and used that against the one you recieved for the ultimate conclusion.

if he leaves you - feedback, I've seen people put replys with a link to a web site explaining why they recieved it. You could do the same with your explanation, and post the pics up too! :) At least the next few people who you trade with will see that it was not your fault, and when it's off the 1st feedback page, who cares about 1 minus feedback in a sea of positive?

This kind of thing happens all the time .

Mr x puts a game up for sale and mr y ( who has a busted version ) buys from mr x .. mr y then sends his busted copy back to mr x and says its broke i whant my money back .

This scam has been going on in highstreet gaming shops for years ..I may ( or may not ) have even done it myself at one point :D

Little tip :

If your selling a game ( or anything for that matter ) use a fine line ultraviolet pen and make a small mark on the game befor you send it , This way if mr y sends back a duff disc you will know 100% that it is not yours ;)

As for your mr y ... Im sure he will be delighted with fixed sellotaped copy :D , If he is not trying to blag you he will make a big stink about it being a bad deal ( but i dout that he's not blagging you ) and you and he will have to live with it .

IMO the reason you got a differnt case back is due to the fact that the guy is so dumb that he sent his case and not yours ...tut tut mr y

maddad68: that's exactly it! People trying to pull a fast one.

This is why I mark CDs and cases. If someone tries to send back a CD/case that blatantly isn't mine, I'll pwn their ass.

Don't do this.. ebay will remove any feedback which contains a link to another website, it's clearly in their rules.

If he has paid via PayPal he's going to get his money back anyway - you might as well give him a refund and not bother with having a negative.

If he hasn't paid via PayPal - don't give his money back and suffer a negative if you have to.

You can then try and use SquareTrade to mediate the transaction (does cost about 10 USD) if he is an idiot and doesn't respond within 10 days, the feedback gets withdrawn automatically - if he does then you have someone who can try and resolve it - and the mediators usually know what they're doing.

Recieved an email this morning:

yeah, i have the original case here still. it was badly already
damaged,
cracked and broken when i opened the package. i didnt want to send it
back
in the original case in case you thought that it got damaged on
returning it
to you through the post, sorry but someone has accused me of that
before. i
can send you the original damaged case back if you want. In any case
though
if you sent it off and it was fine and i received it damaged then
obviously
that was done in the post. Any suggestions?
Mark

So I am thinking I'm dealing with a fool rather than a scam artist for two reasons.

1. The disc was in such a bad state that I am obviously going to realise it wasn't sent out like that.

2. They paid by cheque not paypal so they can't chargeback.

Obviously the blindingly obvious idea of claiming for breakage from the Royal Mail has eluded them.

I think I will explain to them about what you do when stuff breaks in the post and send the game back. They have good feedback so I suspect they are just a bit behind the door.

Hang on, so he originally told you that the game was scratched, but now he says it arrived badly damaged and broken? Why didn't he say that in the first place then? It still sounds strange to me. If a game disc arrived cracked in half, you wouldn't say it was 'scratched and unplayable' would you! Oh and his comment 'someone has accused me of that before' is very telling also - so this isn't his first time doing this kind of thing obviously.

Yeah but he has admitted it was damaged in the post so I'm free of any obligation to refund him now. If he wants to scam money from the Royal Mail he can but he wont be getting any from me. I'll post the game back and let him sort it out like he should have in the first place.

He says the case was badly damaged and broken, originally he said the case was in perfect condition and only the disc was damaged. Honestly some people shouldn't be let near a computer, if they are a scammer they are the worst I have seen.
