Does this count as drink driving

Right my mate can't drink for 2 weeks so he was giving me a lift back from town, cheap taxi like, he dropped a lit fag on the floor, so i took the wheel while he found it.
Is taking the wheel while drunk drink driving? Nothing on the road it like 3 in the morning.

We were just debating it this morning over coffee.
 
I doubt it would go through court as a conviction against you but your mate was most certainly driving carelessly and he could be prosecuted for that.
 
Yes that's drink driving for you and driving without due care and attention for your mate - possible careless/dangerous driving too.

Shouldn't be smoking behind the wheel full stop IMO. If you can't use a mobile whilst driving, why should you be allowed to use a firey stick that completely diverts your attention if/when you drop it.

I would say yes it is. Also driving without due care and attention or probably dangerous driving (knowing that you are over the limit) on the part of the driver. Please don't try this again, for the safety of other road users and your own. Saying "there was no-one around" is never a valid way to predict if another car is about to come down the road.

Is it not 'being in control of a vehicle whilsts intoxicated' or sommit. If so then yeah you would get done.

+1 you hear of ppl getting pulled for eating a sandwich/drinking water at lights and stuff, im pretty sure lighting a cancer stick is actually more attention diverting than taking a swig of evian
 
Look on the bright side, you did not buy a car from Car Craft nor Claim to have recently got a new M3. ;)

Only if there was a strong tail wind and you were breathing the smoke from the car window before being hit :p
Otherwise it's just passive deadness.. as opposed to active deadness, where you do it to yourself.

i *think* that the driver would get driving without due care and attention because he was looking on the floor for the fag (which he shouldnt really be smoking whilst driving but thats different matter) and the passenger would probably get drunk in charge of a motor vehicle
depending on if the passanger had license etc could get driving otherwise in accordance to a license also (probably wouldnt get through court though)

best thing for him to do would have been check rear mirror, hazards on, pull in / stop
 
im pretty sure he wouldnt be charged with drink driving as hes not techincally driving as hes not in charge of the steering and propultion of the vehicle. more than likely will be drunk in charge.
