Does VAT not included have to be advertised?

So I ordered a new lens on Amazon (can I mention them?) through a third party seller, no where did it mention that the price didn't include VAT.

Last night I received a message from them "The total price did not include VAT. Please confirm if it is ok to dispatch."

Then a few minutes later I received an automated message saying it had been dispatched!
 
Odd I had a response back after asking the seller what was going on.

Dear Paul

The total price is the price. No Extra to pay. No VAT charged or added.

Then why did they say

Took a bit of digging but finally found something on the site:

2. Fixed Price Sales

2.1 Under the Service, items are offered by sellers for sale at a fixed price ("Fixed Price Sales"). Unless otherwise agreed by us with the seller in advance in writing, the price of any items sold using the Service (including the applicable delivery charge) are displayed inclusive of any customs, import, export, and excise duty, VAT and other taxes which may be applicable and sellers may not charge or seek to charge the buyer, or allow the buyer to be charged, for any customs, import, export, and excise duty, VAT or other taxes which are additional to the price displayed for the item on the Site.

Thanks, yeah I assume so?!?! We'll wait and see if

(a) I receive it
(b) They charge me the price they advertised.
