you can take the name,
however you will probably loose it if the brand owner decides they want it, especially if you are in some way capatilising on their brand.. be prepared to go to court with them trying to force the name from you if the TLD people rule in your favor.
the only chance you would have of keeping it would be if its a situation where... hmmmm your name is MR dlink and you register dlink.info to sell kitchens... possibly... the TLD people may rule in your favor, but then the brand owner would probably take you to court..
