Finally handed in the keys with our landlord today. He inspected the house hardcore. He didn't spot anything wrong. we had steam cleaned the whole house including all curtains and carpets etc.

I have put the request in tonight for my £895 deposit back.

Let's see if he plays silly buggers. What he doesn't know is I took many many photos before he came around today.

Only one thing he asked was we clean the front driveway as against the one fence was full of leaves. we handed the keys in and he left whilst we cleaned all the excess leaves away. I took before and after pics of that too.

I'm expecting him to complain about something for sure.
 
Well currently the landlord/agency have not responded at all to my request.

Deposit status AWAITING AGENT/LANDLORD RESPONSE

The only issue is that my paperwork shows the Agent/Landlord is Heywoods Ltd (the estate agent)
but they were not involved in any of the tenancy except for finding the tenant at doing the credit checks etc with me. Once that was complete the entire process was between myself and the landlord directly, the agents were not involved.

So I don't know who the request has gone to with the DPS claim. If heywoords then they are not involved. So they may ignore it!

Any idea how long the agents have to respond before the monies are just default allocated back to me directly?
 
well its been 9 days since I have put in the claim for my funds back and the landlord/agent still haven't responded to it. Gunna call the DPS later I think.
 
Nope, Haggisman is wrong.

I have called the DPS scheme, and after 14 calendar days I can start a "single claim" for the funds.

This involves me completing a legal document which MUST be signed by me and witnessed by a solictor or magistrate - of course I will have to pay a fee for this. Then I can submit that to the DPS scheme company, this claim essetnially then gives the agent/landlord 10 calendar days to respond before the DPS can just release the funds to me without approval from the other side.
 
sorry haggisman, didnt mean to correct you, I wish you was right, cos doing it the way the DPS scheme advisor told me is crap and costly.

Also with regards to the claim I've read if I want the landlord/agency to cover my legal costs I have to apply to small claims court to get it back. No idea what the costs are for the solictor to witness my signing though, maybe its so low it's not worth the hassle.

I phoned the agent to chase them today and they said they are awaiting my actual landlord to instruct them.
 
Well I have escalated this to a "single claim" the DPS Scheme are sending me the document I need to complete to start the procedure.

I have checked with a Conveyancing solictor, they only charge £5 to witness my signature, so once the paperwork has arrived I will be doing this.

I have spoken to the estate agents who found me as a tenant (they didnt continue any involvement in the lease) they deposited the funds, they are 100% aware that I want this sorting, but the actual owner/landlord is not responding to their requests on this either. The thing is they are in communication with him anyway as he has used them to find another tenant, but he wont confirm anything regarding my deposit.
 
Lol what an asshat, have you previously upset him?

Not really, other than he did some repair work and 10 month later he decided I should pay towards it (it was repair the waste pipe that cracked outside my upstairs bathroom - which I refused as I didnt cause any crack to a pipe outisde the house on the 1st floor)
 
Well after the esate agent who was used just as a tenant finder has been chasing the landlord for me for 3 weeks with no resolution.

I escalated the deposit to a claim and I received the paperwork today, I thought I would email my landlord directly today advising that I was going to start a claim.

Interestingly he decided after I emailed him his reply to me was that he sent the agent an email the start of last week an email authorising the estate agent to release the funds fully for me.
So I called them agent and they said they received an email only 5mins before my call to them. He actually forwarded me the email showing the date and time as 3pm today.

So finally it got sorted, seems my landlord wanted to string it along just enough to annoy the crap outta me, but at least now intelligence previals and the estate agent stayed on the phone with me and we completed the online forms to release the funds to me, so next 3 days I will get my full £895 back!

I think the main point in this was that my email today advised I have full SLR quality photos of every room, wall, ceiling, carpet, floor and inside every cupboard and cooker and dishwasher etc, showing that the property was handed back in 100% perfect condtion.
