Driving when wasted?

What would you get done for if you were pulled over and were wasted when driving but the high was legal?

Obvisouly if you were all over the road then it would be wreckless driving but if say, you had a headlight out but were trolleyed then tested and had no alcohol or illegal drugs in you then would you be fine?

I ask because a mate was driving whilst still a bit high from the night before when he had a legal drug. It seems to have swept accross yorkshire and everyone now knows of it. I wont name it because I dont want the thread locking or removing like the last one

:rolleyes: sorry. I meant anything that you dont usually get arrested for. ie drink driving or drug driving. Coffee is a drug but I dont think you can lose your licence for having 10 espressos
 
You could just say on behalf of your mate that he has recently lost his mental abilities - the cops wont do him for driving while being a retard as I don't think there is legislature for that.

lol. Half of the people in south yorkshire probably fall under that category! We were out a couple of saturday ago and he drove sunday morning. I could tell he was still wasted but his driving was fine. Just like he'd had a lot of coffee
 
I think the point was that if you're under the influence of something that alters your ability to drive with due care and attention, legal or not, you shouldn't be driving.

Playing with the radio/cd player, doing makeup and not having much sleep alters the ability to drive. Lots of people still do it

but he said wasted, so for me wasted is 1 fish finger, how many espressos? im not sure but when i start twiching randomly i would probably say another 10 of them?

I have known people in the past to have had large quantities of ecstasy then driven home in the morning, sometimes hundreds of miles. If anything they said they were more aware and cautious than usual. Having 10 pints is a different type of wasted to some illegal/legal drugs... personally i dont drive (or can but havent in 7 years now)

But if you were pulled over because a bulb was out and then are tested and found having a substance in your system it should not be prosecuted - who cares what you had in your system, as long as your standard of driving was acceptable then it doesn't matter.

I think the same, but i dont think police would see it like that. Like if someone crashed into you and you were found to be drunk. It would still be your fault i think

Everyone keeps on saying 'under the influence' but under the influence of what?

Can you be 'under the influence' of anything that changes you?
 
Who the hell would want plant fertiliser in their body?

Its been proven that its got nothing to do with plant fertilizer and is only linked to it so it can be sold.

Dj_Jestar - Wasnt me that was driving, as i said i havent driven for years. Just trying to work out how in the crap someone would be who can drive as normal but is still a bit 'awake' and someone could clearly tell that

Infam0us - Boxing day made illegal, thats news to me. Whats it been classified? Last thing i heard was that it was being made illegal in March

Anyway, back on topic of driving, before it gets pulled...
 
driving while unfit I believe would be the charge I think, could be too much caffeine for all they care, you're unfit to be behind the wheel of the car.

What if a really fat person was driving? There heart could go at any time

Or a really old person
 
Section 4 of the RTA 1988 gives three offences relating to this. Driving, attempting to drive or being in charge of a mechanically propelled vehicle when unfit through drink or drugs. All that must be proved is that the person's driving ability has been impaired. You do not need to prove how much of the substance is in the person's body.

Coffee is a drug though. If someone had this legal substance in their body that im talking about, and it didnt show up as 'drugs' what would happen? Nothing?

edit - I remember someone informing me a while ago that this stuff im on about shows up in your system as smack. Proably a load of twoddle though, like all the rumours about things

So, it would be wreckless driving. Unless it came back as a drug on tests. However it couldnt be wreckless drinving unless you were driving wrecklessly... So it would be nothing? I dont get it

Headlight out/tinted windows etc > Stopped by police > Look like your high > Agree to testing > Comes back as nothing in your system > Free to go??
 
I know its stupid. However you can be impaired by lots of things other than alcohol and drugs.

What im asking is, can you be tested (when no driving wrecklessly) be found clean, then free to go. Dispite looking high as a kite?

If a test came back as positive for drink or drugs you would get what for. If it came back as negative, even though you still looked high, could police do nothing? This is whilst not driving dangerously
 
they give you one of those American style tests (you walk the lines etc) fail that and they book you iirc.

But the police wouldn't (and couldn't) make you give a blood sample at the side of the road for "looking high"

Are right. So you are asked to touch your nose, walk line etc. Didnt know that.

Could you be taken back to a station for a blood test for looking high? Not that it would matter anyway, as its legal. How do they stop people for drug driving then?

If they cant make someone give a blood sample at the side of the road, how do they check to see if you have Ecstasy or Weed in your system? Or does another test show these up. (Same for any other drugs i suppose)

Quite right. As I said though, my mate was just a bit high still from the night before. Writing about 'driving wasted' was incorrect by me. He just looked a bit too 'awake' still, his driving was normal though

I know a lot more people around my dads age and older (50s, 60s) who regularly go to their local after work, have maybe 5 pints then drive home. The majority live in the countryside, but i think country lanes are more dangerous than main roads.
None of my mates will drink even 1 pint when driving
