How does DSR work, you just send it back, even though some of the plastic packaging for example has been taken off and clearly the box looks like its been opened, would a retailer just accept it and sell it on?
 
As long as you send it back in reasonable condition you shouldn't have any problems. Just pack it back up and return it. Doesn't matter if you've opened it or whatever. The retailer will check it when it comes back to make sure you've not done anything stupid with it like ride over it in your car or set fire to it, and will then refund you, they'll then usually sell it as B-Grade (i.e. opened/damaged packaging/no packaging, but essentially fine).
 
Actually I have left the plastic that covers the cooler. But would the retailer just sell it again?

I'd hate to have a box or component that had previously been used, even to the extent the box being opened.

However I'm really considering sending the gigabyte 7970wf, its performs solid but not a great overclocker and runs hot, 85C (100% fanspeed) atm at 1187mv 1125/1510.

How much does it cost to send back a gfx card, 7970 size (random q. but im sure people have done this on this forum)

dont forget to tell them clearly you want a DSR refund

I made this mistake and they categorized my return as RMA. 2 days later I received an email about the returns penalty since there was no fault found :D
 
"The item must not be used and must be 'as new' when returned to us." - this is what they say, but surely you have DSR so you're able to try the product and make a decision.

Complete and utter ****. They say it in their T&C, but under the DSR you only have to "Take Reasonable Care". You can open and inspect it, and even try it out. They MUST refund you within 30 days. Simple as that.

Any retailer that says they cannot accept it is clearly in breach of the DSR and must be reported to trading standards. Likewise if they try to charge you - processing fees, credit card fees, restocking fees etc. If they are a business and selling from a distance, then they cannot lawfully do it.

Tell them this. Do not take no for an answer. Tell them within 7 days of you receiving it that you want to return it under the DSR and within 30 days you must get a refund of the full, total costs paid, including outgoing delivery. You will have to pay to return it though.

Awesome thanks for clarifying. Good to know, i've had the card 5 days now, will decide tomorrow if its worth the trouble, but as I say i'm not impressed with the card, maybe reason enough.

Even awesomer! But probably best i make a decision sooner rather than later. Getting some opinion for people around the web, will hopefully make my mind up and contact retailer tomorrow.
 
Just bung the request in anyway, you have 28days to return it after you put in the DSR request, at least then you know your DSR time isn't going to expire. And in the mean time if you change your mind, just don't return it.

I am sure I read somewhere that if you do this then the retailer can charge you a "fine" (set amount). I'll have a look where I think I saw this in a little while.
 
Nope. No such law. I've put requests in before, only to change my mind and decide its not worth the hassle.

You can either just let the DSR request expire, or let the shop know and they'll close the request.
 
under DSR, there is no 28 day limit on returning the item, and the retailer still has to refund you within 30 days regardless, however if you refuse to return the item they can arrange to have it "recovered" and charge you the cost of recovery

if you sent in a DSR request and then didn't send back the item and didn't chase for refund, then the retailer would assume you no longer wanted to DSR the item... however if you did chase them for refund without returning the item they would then demand the return and/or arrange for someone to come and knock on your door

@Gibbo - regarding DSR as a retailer do you accept items that have been 'used' i.e tested out. And if certain packaging like plastic wrapping on a gfx cooler has been removed etc.
 
Yeah they do. I've sent GPU's back in the past that were just too loud and never had a problem.

As I say, as long as you've taken reasonable care of the item you shouldn't have any fuss returning it.

Yes. As long as its returned in OK/reasonable condition with adequate packaging and with no physical damage then yep shall be fine. :)
