Dxgmms1.sys BSOD

Hello guys, i'm about to give up on this BSOD im getting i cannot find any solution to it i have tried everything i can think of.
When im running my pc everything is fine, when i load a game (GTA IV) about 20 minutes into playing i get a blue screen everytime due to this Dxgmms1.sys, i have looked around many forums all offering solutions to it but none seem to resolve the issue, i recently had to RMA some patriot viper ram i purchased from overclockers as 1 stick was faulty and i have been having this BSOD ever since i have put the new ram in i really hope i dont need to RMA it again but i have tried everything else.

Uninstalling/reinstalling graphics drivers
Tested each stick of memory with Windows Memory Tester (all came back clear)
reformatted and reinstalled operating system, even went from vista to windows 7 but problem still occurs (when using windows vista i recieved a dxgkrnl.sys error instead of the Dxgmms1.sys im recieving now.
Using older version of the graphics card drivers
Replacing and rearranging the ram

All these are what i have picked up from different forums and still the problem remains.

Here is my pc specs

Patriot Viper triple channel (3x2GB) 1600mhz
Intel i7 930 2.8ghz (clocked at 4ghz)
Geforce 9800GTX+
Gigabyte GA-X58A-UD3R motherboard

As it was a preclocked bundle i bought i thought that the overclock wasnt the problem so left it until now, i took a picture of all the settings in the bios and reset everything to default then played a game for a good hour with no blue screen, so im presuming its something to do with the overclock.
I'm farely new when it comes to overclocking so if anyone knows the kinda setting that would cause this i'd appreciate the info thank you.
