E8400 reporting slower speed

AS mentioned, just installed my new cpu from my old E6600, which was 2.4ghz and this E8400 is reporting as 2.4ghz as well should i have changed anything in my bios? i updated my Bios to a newer version as the asus website said that it supported the cpu on *** newer bios

It sounds like C1E and EIST lowering the cpu multiplier to save energy. Try disabling them in the bios.

i was thinking maybe memory settings as the cpu is rated at 1333mhz, heres the mem im using http://www.overclockers.co.uk/showproduct.php?prodid=MY-058-GL&groupid=701&catid=8&subcat=, i did try to change the memory setting to 1333mhz but when i rebooted it said overclock failed.

According to CPuz Dram frequency is 266.7 mhz

also i heard something about vista being able to interfere too (power/performance settings), but i see your using xp pro

the dram frequency should be at 400 under the memory tab in cpu-z when the cpu is at stock speed.

Did you reset your bios & remove the battery. I think that may sort it.

Think ive sorted it, went into some part of my bios and instead of doing a manual config, like changing the ram voltage to 2.1V ( which i read its meant to be) i switched it all to auto, now its reporting at 3ghz, but will see if its the same when i switch of my system tonight and back on tomorrow.
