ebay advice!

Bought a Sky router from an ebay seller who has 100% positive feedback.
It was listed as New and only opened to check contents.
I've just picked it up from the post office and opened it and to my dismay there are scratches all over the top of the router and the powerpack has clearly been opened or more likely used as the cable is not how it would be tied up as new. I paid via paypal. What would be the best course of action?
 
Yeah i can see what you're all saying but i specifically bought a new router as i wanted a router in new condition. If i wanted a used scratched up router i would have bid for one listed as used and paid less for it as they sell for less on ebay.
 
Thanks for the latest, more helpful replies. I've contacted the seller giving him two options.

1) Full refund including my postage returning it to him
2) A partial refund which would amount to me paying the typical price for a used one.

Let's see what happens!!
 
It looks like the router has not been looked after carefully. I've had routers for years and they still look brand new but i would never list them as being new if i were to sell them.

sky netgear wireless router dg834gt 108mbps this is a new item just opened the box to check everything is in it comes complete with all the filters (3) all the cables and disc with instructions.
 
I got it for £16. I've been watching them for a week or two on ebay and new ones have been going for £25 buy it now and i've seen new ones sell from £13 including delivery. Used ones, however, have been selling for £6 inc upwards usually depending on when the auction is ending. However, it's not about the price i paid. Whether i paid £2 or £200, i bid for a new item which i expected to be in new condition and it is in far from new condition therefore the item was missold.
 
Outcome:

Although i would have preferred a cosmetically perfect router for the price that i paid, the seller has admitted he must have made an honest mistake and has agreed to a partial refund of £7.00 if i keep this one.
