Ebay defective item advice

Hi, I purchased a (Chinese) piston & cylinders kit or £40 for my grandkids quad atv.
Item arrived and everything looked ok.

I fitted the new piston to the con rod, then pushed down the new cylinder.
On the first pull, the piston seized in the cylinder.
After about 1 hour we finally got it off the quad.
Obvious this scratched the cylinder wall.

On further inspection it turns out that the gap marks for the piston rings are in the wrong place on the piston.
And basically they can pop open over one of the ports in the cylinder. Therefore its a manufacturers defect imo.
I measured the gap marks on the original oem piston and the newer one the gaps are 15mm smaller

I raised a return with the seller, and they really tried messing me around.
They originally offered me £10 refund and said that i should just re-sell the kit lol.
It took me about a week of messages before they issued me a return label.

Now they are saying that the item was used, and damaged so by ebay rules, they are offering me 45% refund of £18.85.
What are my rights?

Tldr. Bought item on ebay, fitted it, realised it was defective, item was damaged on removal. Now seller only offering 45% refund.
 
Welcome to ebay, amazons becoming full of cheap chinese tat too, it's basically aliexpress now with western prices

Why are you still talking to/letting the seller mess you around? Item is not as described/faulty so go through eBays dispute process and get refund/replacement
When i get home, I am going to raise a dispute.
Was just checking my rights basically.
 
Make sure you document everything in ebay messages to the seller before "raising to ebay"
 
Just be aware that ebay may swing with the seller on this one. The item was fitted. The seller could claim the buyer fitted it incorrectly thus causing the damage to the item.
 
Op didn't check replacement part was correct and now frothing.
Kind of right.
The item is described as a compatible part for the atv.
I checked some of the supplied parts like,
Putting new piston into original cylinder,
Putting new gudgeon pin into old piston.
Putting new piston bearing into old piston.
All these were fine.

Without knowing about the defect, it very easy to put the oil rings on the piston and put it into the cylinder, then as soon as it goes up and down, the oil rings can pop out and seize up the piston.

Waiting to see what ebay say now
