Ebay issue - Batteries

I won an auction for two original canon batteries, two 3rd party batteries and a charger all to use with my 5D Mk3.

The auction stated the 3rd party batteries were as good as the originals and the seller had 100% positive feedback so I placed a bid an won.

However, the 3rd party batteries are actually not the issue. The two originals are showing a red square in the status section which means they're basically ready for the bin.

I emailed the seller after I found this out asking if he knew this to be the case and that I would like at least a partial refund if not full refund as the batteries shouldn't have been described as they were.

So, this is my first potential ebay case. Do I have grounds to raise a case or I'm I out of luck? If any of you guys have had similar dealing I'd appreciate your input.

That said, eBay generally side with the buyer by default and then put the onus on the seller to prove their case so you'll likely get your money back.

This listing includes 2 original canon batteries and 2 third party batteries (but they are as good as canon) + the changer and the UK power code.

I am selling all my kit (7D, 25-105 L lens...etc.) as I am now going with mirror less (Canon EOS M3).

Have I asked it over and over? As I explained, this is my first potential dispute and I'm asking for advice so I get it right.

Update.

So the seller came back with...

"I am sorry, I can't accept return. The listing itself stated that returns are not accepted. These batteries are used but they were fine up until I sold them. I sold my 7D and all other camera accessories on Ebay as I am now switching to mirrorless. The other point is these are batteries, I have no grantee how you would have changed them and used them while you had them. So i simply can't accept this at this point."

I charged them with the charger supplied in the auction as they were discharged on arrival and emailed him the next day.

Thought this would be his response so I'm going to wait the 10 days and let ebay sort it out.

Looks like I have to wait until the 10th before I can progress the case.

I said I'd be happy with a part refund as the other two batteries and charger are fine but he's having none of it. I'll just have a full refund then

Update.

Case now gone to ebay to decide. The sellers last comment claims that I was expecting new battery condition which I've haven't and has stated that I'm messing him around!

Hopefully they'll see through his bs and the claim will go in my favour.
