Ebay Order Mess Up

I recently bought a Nintendo Switch Lite and some games off a competitor store from Ebay. The order went through and everything was fine. I used a £25 off discount code, and got the console and game a special price before it went back up.

Now I received the order and one of the games was missing. It was also missing off the dispatch note (receipt) which was inside the parcel. I phoned the competitor, and they said the missing game isn't shown on their order and are suggesting I ordered it from a 3rd party. I have screenshots that prove otherwise, especially as the tracking number is shown being the same for the Switch and the games.

Somehow either a glitch or a human error has missed off one of the games by the competitor, and now they are refusing to send me the game. I phoned Ebay who confirmed the game should have been part of the order, and opened a case on the resolution centre. I uploaded all the screenshots as confirmation that the game should have been included, but they just want me to return all the items for a full refund. It would be pointless as I saved £45 at the time of buying, and the game only costs £40.

Is there any way of getting the competitor to send me the game that I paid for? My only option may be to leave a negative review, and never buy anything from them again.

I’m guessing this is a case of them realising they were underpriced and withheld the game in question. Can’t help much but wondering if this is this something Trading Standards (or whatever they’re called now) could help with?
Is the game listed on the e-receipt/dispatch email that should come through prior to dispatch from eBay?
Tell eBay you want the ‘bundle’ you paid for as it was a gift and as such returning is not an option now.

They were messing around with the pricing quite a lot, it was jumping up and down by £20 all morning (the console), and I got the last one before they raised it back up again. The game that is missing wasn't the one which was fluctuating in price. I have order confirmation that lists the game as part of the order from Ebay, but the competitor never sent me a direct order confirmation e-mail as it was done through Ebay. I also have the Paypal confirmation that lists the items and prices.

Tonight I phoned again (the competitor), and the person on the phone was more agreeable and I was able to forward my screenshot proof that the game was part of the order. They agree, but told me that they never received the payment for that game. This made me ask where has the money gone then? Now they are looking into it, and hopefully they will phone me back tomorrow after they've checked their database to confirm they have the money. It sounds like their ordering system has an error, but even though they have proof, they wont send me the game unless they have confirmation they received the full amount of money.

Quite strange as they are the largest computer / technology retailer in the UK and they'd hardly lose out sending me the game.

Also Ebay cannot help, other than request a full refund. I don't have any interest in a refund due to the original savings, I just want the competitor to send the game.

Why all the skirting around posting the companies name? OcUK don't sell the Nintendo Switch or it's games so they aren't a competitor.
They sell computers aswell so thought best not post it, you can probably work out who it is they are the largest highstreet PC shop.
 
are they still selling the game, if so why can't they dispatch it ... ? as discussed before, sellers can just say we broke the item during packing, or similar excuse,
if they mispriced something.

Don't understand the stuff about screen shots .. you have an unambiguous paypal receipt showing what was ordered ?

Yes they probably have 100+ copies of the game in stock.

I have no way of explaining how a large corporation IT ordering system functions and how it links up to the ebay ordering system, or how it fails to in this case. They just say they never got that part of the order on their system, but hopefully the person I spoke to can contact the "ebay department" of their company who can find the fault. Probably caused by some incompetent admin staff who deleted part of the order and hoped it would be forgotten.

I've never had an issue anything like this before, and wont be buying from them again.
 
You could try taking the whole order in packaging to a store and see if they'll give you the missing game.

Go in friendly and hope for a naive member of staff :p

Alternatively say the items are a gift and you don't have time to reorder, ask for the game to be delivered or a partial refund

OK .. they somehow screwed up .. but there should be no reason to take screen shots when ordering on ebay, you ok/confirm the paypal order, which you have checked by eye.

( when ebay have special deals, if you are purchasing from an ebay shop eg. crompton&moore , that has their own web-site, you can ring them directly and negotiate the same purchase at a cheaper rate, cutting out ebay )
 
Ah right I get you now. The game was a separate ‘purchase’ to the console - as in it wasn’t a actual bundle deal.
I’d read it as the game was part of a bundle deal so was thinking they realised they’d priced it wrong and were trying to withhold the game in a ‘oops that shouldn’t have been part of the bundle’ move - not that they can do that legally as far as I’m aware.

That being the case, you’ve a receipt to prove you paid for the game (and console) That’s a pretty straight forward issue that should be resolved relatively quickly with the seller once you show them the proof of payment. What happened to the payment after you made it is irrelevant, at least as far as you’re concerned. They’ll probably need a day or so to chase internally with eBay but I imagine it will rectified without much fuss.

Shops are protected from pricing mishaps, it's a common misconception that the shelf price is the price they must sell the item at.

Normally in the case of a bit of a screw up, they'd just cancel the entire order rather than partially fulfill it.

I'm aware of the seller protections regarding pricing errors but as far as i'm aware they can't just withhold a part of the order because they messed up, at least not without notifying the customer first and then allowing them to either cancel the order or accept the amended version. it's a moot point anyway as this doesn't appear to have been the case with the op.

By taking payment and partially shipping they have accepted the transaction surely.

Just to check when you say bundle was it several individual itemslistings that bundles together or just one listing with all the items in it? If the latter are you sure all items are from the same seller? If the former take the case to eBay you have them bang to rights.
 
None if it really matters tbh. If it's clesrly part of the order they either send you the game or ebay will request that you return the item and issue a refund.

For all the negative ebay posts here theie process for complaints / refunds is very by the book.
 
You knew this was an error/glitch, which is why you took a screenshot. Now you have to deal with the hassle.

You can either keep it or return for a refund, pretty straight forward.

I don't think he was exploiting a glitch as he says

Which is why he took a screenshot because they refused to send the game.
