I'm going to buy a piece of electronic equipment off ebay and the seller has classed it as 'spares or repairs' and then claims that it will not be returnable. Now I believe that this would contravene with the DSR as I am unable to inspect the item before purchasing so I would be able to have a seven day cool down once the product is received. Would ebay side with me if it turns out to be faulty?

Secondly the seller has asked me to make an offer for the product (even though it is BIN) and has agreed for the cheaper price - what is the best way to do this, should I encourage the user to remake the sale through ebay so that we are both covered?

Auctions sales aren't covered by DSR neither are private sellers.

If you can prove he's selling the item as a business you might have grounds to be covered by DSR.
 
If its a private seller, distance selling regulations aren't applicable and they don't have to accept returns.

A business seller will, but something being sold as spares is obviously not going to be ideal. Surely better to ask lots of questions about the item if unsure.
 
Personally I think you're a tool if you buy an item listed as "spares or repair" and then attempt to send it back if it doesn't work!

Why thank you for your comments, that really helps answer my question...

Anyway as for the rest of you thanks, there was something on the website though when I clicked through to ask a question which stated that a BIN was covered under the DSR. Its a front fascia for a car stereo which my girlfriend has lost, and not being someone who really knows whats in one of these how likely is it that its not going to work? I can't imagine theres a huge amount of electronics in it?
 
Ordered and the gf has paid, so we'll see what its like when it turns up. Its almost impossible to get a single front fascia for an old stereo like this. I suggested buying a new one but she thinks its a decent one.

DSR does not apply to auctions.
DSR does not apply to private sales.

if its sold as untested/faulty/spares or repair then I would take it as exactly that, you are buying something that may not necessarily work. A bit of soldering or replacing apart and yea it might be fine. But if your thinking of purchasing it then returning it as it doesn't work then that's pretty shady.
 
Spares and repairs means it does not work, and it is only good to use as spare parts for another device, or it need parts replacing for it to be working again. The seller is being perfectly reasonable by not allowing returns, as the device is clearly marked as broken.
 
On the upside, if it's "spares or repairs" because it's just the fascia, it's probably ok.

I'm pretty sure that if the auction said "spares or repairs" eBay will side with the vendor and they clearly said it may not work.
 
In this case I would assume "spares and repairs" would mean its a working component that is a spare part or you can use it to repair the stereo with. The guy sounds like he has just listed it a bit wrong.
