Grrr! Sold my car on ebay, auction finished tonight. Winning bid was £310 (it is a bit of a heap so i'd take that) and the winner suddenly turns round and says 'Hi sorry to mess you around but some one has used my phone to bid on the car and I need to cancel the item.'

Now, I take it there's little to nothing I can do about this is there? I can't even leave feedback as a buyer/bidder can I? The highest bid was the winning bid since about Wednesday so unless he hasn't looked or checked ebay at all since then there's no way he won't have known!

So he's trying to back out, probably as he's in Gloucestershire and I'm in Scotland (even though location was clearly marked AND in the advert) and it's collection only.

So I give the second place bidder (£300 bid) a second chance and he comes back with 'if i knew I was going to win I'd have withdrawn my bid' and offered £200! Bloody cowboy! Is a non winning bid binding? Is the winning bid binding at all? ARGH!!!

A bid or purchase on eBay is considered a contract and you're obliged to purchase the item. However, if you feel that you have a legitimate reason for not buying the item, you can contact the seller and explain your situation. If you haven't done so already, request the seller's contact information, explain the situation, and see if they're willing to cancel the transaction in the Resolution Centre. If the seller opens a case, you'll receive an email asking you to agree to the seller's request to cancel the purchase. Make sure you accept the seller's request promptly.

If the seller doesn't agree to cancel the transaction and you don't pay for the item, an unpaid item will be recorded on your account. If you get too many unpaid items recorded on your account within a short time period, your account may be limited or suspended.

Request a listing refund and auction it again. Move on.

It's not, you will never get them to pay. Ever.

File a non paying bidder report, get your fees refunded, relist the car, move on.
 
Had this with some bits I was selling last week, the bidder always has some pathetic excuse like "oh my paypal doesn't work". I then offered to take a cheque and they suddenly change their story.

Sadly you can't force them to pay but you can get a non-paying strike against their record, just open a case against them and then in 4 days close it. You will have all fees refunded and they get a telling off for being a muppet.

No, they are hoping that he will sell it for £200 rather than go through the hassle of relisting it.

The problem is a car worth £300 is going to attract these kind of people.

ebay says

Bidding is meant to be fun, but remember that each bid you place enters you into a binding contract. All bids are active until the listing ends. If you win a listing, you’re obligated to purchase the item.

doesnt stop morons bidding what they cant afford. but if they do it enough, they get suspended
 
Happened to me many a time, it's just part of the game unfortunately, you will get idiots wasting your time.
Just need to relist and get on with it. You never know, you might get a better price second time round.
