eBay return do I have rights?

Hi folks,

Bought a phone off eBay, received the item but changed my mind, it's still sealed and unopened, emailed the seller said I had changed my mind and would like to return and would cover his postage costs, he is refusing, listing says returns not accepted.

Paid with PayPal credit

Do I have any rights eg open a dispute, or am I stuck?

Do distance selling regulations or anything like that not apply anymore? Haven't bought from eBay in quite a while but I remember buyers always had more rights
 
He's agreed to let me return as long as the security tape is not cut or anything and the serial numbers match up.

Should I ask him for what serial number he has so it's in writing on the messages? He could lie about it maybe I don't know
 
You need to make sure you do the return through eBay otherwise you are just some random dude shipping a phone at this stage.

If you mean by initiating the return process through eBay then yes I have started that. Cheers

Edit: that's why I'm asking him to confirm middle of the serial number once he's done that I'll upload a picture of the box with full serial and it's in the proof of messages there at least
 
He says he's not at home to check the serial and IMEI so I've asked him when will he be able to confirm them as I'd rather he did that before I send it back, otherwise he could possibly make some fake numbers up I'm not sure.

Edit: he's confirmed IMEI number, I'll upload the photos of the serials of the box on eBay as my proof and send tomorrow

What now make a video of packaging and sending the phone showing the serials and everything lol.

It sounds too easy for someone to scam you, we've confirmed serials but he could say when he receives it it's a different phone or something, ah the wonders of online shopping and returns
