That will be 647L then, which is what your new employer should have used.

If HMRC have changed your code to BR, you will have received notification of the change. Have you had that from HMRC?

Have had nothing from them but i also know for a fact they sent off my p45 and they did not change anything at work in payroll.

If you have had nothing from HMRC, then they have not changed your tax code.
Have you actually asked your employer why they are using BR, rather than the code that was shown on your P45?

I dont know whats going on but they sent off all the informatoin to HMRC and im still getting bloody overtaxed.

All i can do is wait why do you have to go out of your way to make it look like I or my employer have made mistakes because at the end of the day the fact we get emergency taxed is bull**** period.

I know they didnt change it.

And we all know HMRC are a bunch of *****.

Because it's the basic level of tax. I.e. how much do you tax someone if you don't know their personal allowance? Not everyone gets a full allowance, or you may be using your personal allowance in another job. So to be on the safe side you get taxed at the standard rate.

What's happening is 20% tax is being taken on all your earnings in case you're not entitled to the personal allowance.

And it's unlikely to be HMRCs fault in this instance.

All I'm trying to do is explain how the system works, so that you can then get to the bottom of it and get it sorted out.

You obviously don't want to listen to someone who actually knows what they are talking about, and would rather moan.

The fact of the matter is, if your employer had done what you insist they have done, which is to submit part 3 of your p45 to HMRC, you would still be on the same tax code, not BR.

I'll leave you with a last suggestion. Ring HMRC in the morning and ask then why you are on BR. Let us know what they say.

Okay maybe I am raging at the wrong people. I still think HMRC is pants because they have caused issues for me and my mother before but! In this case it could swing either way i shall call them up and speak to them tomorow.

Any of you guys had bad experiances with HMRC

Yes, lots. And also lots of good experiences. But then I phone HMRC a lot so that's to be expected.

Put it like this, I had an issue with my tax code start of this tax year. Phoned up the agents line (as they weren't answering the public one) and got it sorted in about 3 minutes. Next month payroll and it was all sorted.

Yeah, that one won't work for you, it's technically for your accountants so they can deal with your tax affairs if registered. I offered to fax in my authorisation for my firm to act on my behalf then call back if the person at HMRC wanted but for some reason she didn't see the point.

Edit: In general the most difficult part is getting hold of HMRC. They are horrifically understaffed.

So to be on the safe side you get taxed at the standard rate.

To be on the safe side you would charge the 50% rate in case they are a high earner. The real reason they charge 20% on all earnings is to rake in as much money as possible to earn interest on it, the proper thing for HMRC to do is to take no tax in case that person is only earning £6k a year and would starve if they were taxed on that.

As has already said, BR is not 'Emergency Tax'. The standard code, 647L, on a month 1 basis is 'Emergency Tax'. This happens to be exactly the same as the code on your P45 - so would most likely be no different.

If you are on BR, then you need to find out who decided to use that code and why. If you read the HMRC guidance for employers, there's not a lot of occasions where they should.

I've just had the opposite - had my first paycheck through (haven't worked since before the last tax year) and I haven't been taxed!

My employer was under the impression I would be emergency taxed, but evidently not. I did fill out a P46 though - anyone have any idea why I didn't get taxed? (only been working a couple of weeks if it makes any difference)
