I have just signed a contract with a big mistake in it on the agencies behalf. Assuming they sign and return it to me, can I invoice for my full hourly rate as stated on the contract? Put it this way. I work on a day rate (regardless of hours) but it seems in my contract, the agency has put my full rate as an hourly rate. I'm under the impression this is a legal contract so it could be rather fruitful for me? (in a very seedy and underhanded way!)
 
Bummer. I really don't like this agency and I don't mind losing the contract though if I can't hold them to it legally then there's not much point in going down that route. It would be worth £151,000 mind :-)
 
Psh?! That all the mistake is worth and you're happy to risk a bad mark against you with other agencies and potentially employers too, ruining your career as a contractor? Don't do it, and find a better job :P
 
I think ruining your career as a contractor would be stretching it a little.. annoying one company yes, annoying them all? Most would expect contracts to be correct and would blame the company.

However the company would probably appreciate some honesty, personally I'd e-mail someone fairly fair up.
 
I'm sorry but if you're honestly thinking about doing this then I feel sorry for any companies you contract for. Awful behavior.

I'd expect any contractor (or person with some integrity) to raise this as soon as they spotted it.

Definitely this.

You'll invoice it, they'll realise their error and change it, you'll get a black mark against your name (and don't think people don't talk between companies) and for what a few extra quid?
 
I don't think you could reasonably expect an employer to uphold a financial error on a contract that would say, take a 5 figure salary up to 6 figures.

If there are errors or ommisions regarding notice periods then, when the time comes you could use it to your advantage as generally speaking it'll be much less costly.
