Eviction of people not on tenancy agreement?

Hello you glorious folk.

quick question as you guys tend to have good answers.

A family member of mine rents a property solely in her name. Has had someone living there with her for a while who she is wanting out of the house however this said unwanted person is refusing to leave.

We are wondering what options are available in this situation before we have to go down the route of physically removing them.
 
Did she ask the landlord about moving said person in first?

Yes the landlord is aware they are there. No this person pays 0% contribution.

Does this said person contribute to any rent or bills?



Was this said person in a relationship with the family member, or did the family member just sublet a room? If the latter then this is more serious as she'd likely be in breach of her tenancy agreement and that could be grounds for eviction from the landlord.

This person was in a relationship with the family member but now has a new partner but still refuses to leave their sty.
If they're not on the tenancy agreement, they don't have a legal right to be there.

If they're paying rent then it's illegal subletting and both of them could be evicted.

If it were me, I would get them physically removed.



That wouldn't work, you can't just include someone on the lease midway through a tenancy. OP has said "A family member of mine rents a property solely in her name".

This isn't going to end well. Not for the tenant or the person who has moved in.

As above no they don’t pay any rent.

I was tempted to suggest she speaks with the landlord about her changing the locks and her being physically removed based on the fact they have easy access to several other properties in the local area.
 
Thank you all for your inputs. I have had a sit down today with my sister to discuss the best options. For clarity. This person her ex girlfriend.

What the current plan looks like is that she will be staying with our parents due to it's location near her work until the third of Jan of which she has told, written a letter to along with an email informing said ex girlfriend she is expected to be gone by the time she returns on the 3rd. The house will be thoroughly photographed and all items remaining documented before she leaves and the cameras around the house will remain active (my sister has a young child as such has cameras around the house to keep an eye on her whilst she is in other rooms doing things such as cooking) And this fortunately has a 48hr dvr connected to it which regularly uploads. So evidence from inside and outside of the house are all covered should ex partner decide to do anything unsavory. The landlord has been informed and is aware of the situation and knows said person will be moving out and has agreed as such to allow me to change the locks which will be done upon our arrival on the third.

Said ex girlfriend just slobs on the sofa all day playing fifa. As an incentive for her to move i am about to phone the internet company and kindly ask if it is at all possible to freeze the connection for a few days so she will bored enough to hopefully pack her bags.

The internet as with everything else is in my sisters name so i don't see this being a legal problem.

From my side i simply can't understand why she would want to stay anyway? Doesn't have any form of relationship with my sister. Doesn't have anything to do with the kid. Doesn't Contribute in anyway. Has a partner elsewhere. Has family scattered around the local area. From what i can gather she is just doing it to be a pain in the bottom which she almost always has been.

Was going to say if it was not for running the cameras I would be switching of all electric and heating and taking photos and tell her to get out now to a hotel your not here to pay for her freeloading. She sounds like a total parasite.

She is a parasite however we have decided it's best to do it this way simply because of the child. We don't want any sort of reactions going on around her so she has been given these few days to pack up and leave. Kiddo will be staying with her grandparents along with my sister but will stay a couple days longer for a "sleepover week"
